Contract Negotiator

My Wright Patterson professional civilian position was with the C-17 Aircraft production and development. I worked with very high dollar complex pre-award, award and post-award procurement/contract activities dealing with contract/contract modification placement, audits/fact finds, cost/price analysis, technical evaluations, cost elemental and terms and conditions negotiations and detailed documentation of these all involving the Contractor, Boeing Aircraft. My position required a government DOD secret security clearance. It also required involvement with DCAA and DCMA approved and recommended rates and factors and applications with Excel spread sheet models and formulas tied to these type cost elements and negotiation positions. I was also responsible for production contractual DD250 aircraft buyoff and contractual/technical waiver resolution and negotiation of this working with Contractor, Boeing Aircraft. I was involved with various types of contracts, including detailed cost reimbursable types and including award fee and incentive fee contract and contract modifications as applicable. Much of the above responsibility was facilitated by a very in-depth contracting or operating system - ConWrite, utilization of business, contractual and legal clearances via detailed evaluations and briefing charts while upholding formal FAR/DFAR/AFFAR and Public Law requirements.

Subcontract Administrator

Even though this position was titled Subcontract Administrator (SCA) as compared to many of the higher positions on my resume, with this position, I filled the role, as the sole DRS, Environmental Systems, Florence, KY division SCA as performing all the requirements of an SCA, of a Subcontract Manager and of the direct program management subcontract support on several DOD programs. In addition, my position also supported the subcontract proposal development role working with cross functional project teams and suppliers on new DOD business/proposal efforts. Considerable involvement with the ERP Oracle Material/Purchasing system was required to support my responsibilities and functions as noted herein. My responsibilities included some very large dollar international system subcontracts, Public Law 87-653/Cost and Pricing Data Proposals and the use of formal Letter Subcontracts to protect Program schedules. I was the focal point for any formal subcontract negotiations and strategies accompanying price and cost analysis. In the short time on this position, I negotiated over two million dollars in cost savings. My responsibilities also included reviewing subcontract performance risk, reviewing and working Statements of Work (SOWS), negotiating subcontract terms and conditions/ DOD customer flow down provisions and meeting approved procurement system compliance on formal subcontract order review. My responsibility also included considerable program/subcontract post-award supplier activity with metrics reporting and presentation support from the Subcontracts organization including DOD customer review. My program/commodity responsibilities for major subcontract procurements involved major assemblies utilizing mechanical, electrical and electro-mechanical subassemblies. My DRS Program examples were battle field shelters or military support stations supporting navigation, supply, and troop subsistence in the field including military trailered support stations on wheels, with associated electronic instrumentation, cargo nets, generators, engines and heating/air–conditioning equipment, etc. Additional battlefield troop support type program examples included biological and chemical warfare deactivation and cleanup systems.

DAYTON POWER AND LIGHT (DP&L), Miamisburg, Ohio 2007-2009 Power Generation Electric Utility – Hutchings Station

In this highest rated Buyer position in Purchasing just below the Purchasing Manager, I was responsible for the procurement of goods and services for all DP&L Power Generation Stations. I analyzed and developed strategic sourcing programs, diverse suppliers and product standardization while developing TCO (Total Cost of Ownership)/cost savings programs, contracts and support of on-going plant operations. My assigned commodities included placing orders and supporting plant operations, maintenance, project and engineering functions for areas such as the following: power generation turbines, generators, boilers, super heaters, sophisticated pumps and valves, electronic equipment, coal pulverizer equipment, soot blowers, ash/asbestos removal, insulation, scaffolding, coal inventory measurement, environmental testing and control, etc. I supported multiple large dollar “outages” involving major plant equipment repair, replacement and maintenance at all DP&L operating stations. In this position, I managed a Subcontracts/Procurement Dept. composed of Subcontract Administrators, Buyers, a Material Specialist and an Expeditor supporting electronic systems programs for DOD military customers. As manager of this dept., I was the key person responsible for hiring new employees, as well as managing, establishing the priorities and challenging the continuous improvement of my staff. I was responsible for my staff and I to meet the quality, schedule and cost objectives for my programs involving the electronic systems via components, assemblies, systems and services needed for program success. This required daily interaction with various Program Managers. I reviewed and signed off procurement/subcontract order packages submitted by my staff. This position was responsible for and managed all phases of the major subcontract procurement effort from initiation of the business case for make/buy decisions through requests for proposals, subcontract management plans, negotiation strategy, definitization and cost accountability. I conducted program reviews and established milestone objectives with the subcontractors and the Lockheed Martin Program Office as required. My position required an in-depth review and adjustments of detailed Statements of Work (SOWs). I managed all cost, schedule, contractual and technical performance requirements levied on the subcontractor. In addition to the technical direction stated above for my position, I was also responsible for the dual role of being the sole expert on my program efforts in the Lockheed Martin, IS&S Dayton, Ohio site for all pre-award, award and post-award major subcontract administration and procurement efforts. This involved the functions of negotiating, administering and compiling auditable compliant major subcontract “Master Agreements” and “Task or Release Orders”. I had sole responsibility for the entire Lockheed Martin (LM) Contracts Mgmt. function at the Tempe, AZ site involved mainly with the Honeywell Technical Publications Contract and with the smaller LM Fort Worth F16 IWTA. My Contracts Mgmt. position was a brand new position supporting several customer site locations. Considering this, I established both a formal text version and a process mapping diagram flow chart version of all Proposal, Contractual and Financial position responsibilities affecting my Contracts area and Business Operations, as well. My position regularly required processing/distribution of formal proposals and contract documents including SOWs. Included with these responsibilities were a review of LM quotes, negotiation on cost/price issues and contract terms issues on task orders and a significant terms modification /negotiation on the existing overall Honeywell master contract agreement. Other responsibilities of mine included formal system contract mods, new contract task order additions and invoice billing mods in a formal LM contract on-line system. Additionally, I performed reconciliation of complex WBS List Spread Sheet Funding Entries to contract mods, contract metrics on cycle time activities, Contract Mgmt. support at all Quarterly Customer and LM internal Program Reviews, improving profitability and cash flow to goals. Other responsibilities included processing customer contract funding notifications and contract type challenges to avoid cost overruns and diminished profitability. Also, I was greatly involved in developing “new business” for our LM site activity.

Naval Electronics & Surveillance Systems – Surface Systems (NE&SS-SS)

Subcontract Administrator, Senior Staff/Cost Account Manager (CAM)

Responsible for huge developmental IWTA as the internal customer for LM M&DS – Valley Forge on the entire Enterprise Communications System for the C4ISR domain and entire Coast Guard (customer) Fleet’s communication systems. This included all internal Coast Guard communications, external communication systems with the Navy, etc. and land based global satellite stations. I also was responsible for a large complete radar system with Raytheon. These above efforts on the U.S. Coast Guard Deepwater Program were on multiple evolving baselines on huge system integration infrastructures. My activities in a developmental LMAP and FAR environment dealt with considerable CLIN/WBS structures, SOWs, complex review of BOEs (Basis of Estimates), Letter Contracts, RFPs, fact finding, negotiation/definitization (large cost reductions), contract and amendment placement (with automated BWS/CPS procurement system included). Extensive subcontractor review and guidance was also required working closely with Program Mgmt. on cost, schedule, technical performance and risk mgmt. As part of this Subcontract Manager position, I was the designated CAM (Cost Account Manager) with complete CLIN responsibility on my IWTA/subcontract activity. Per CLIN, I was ultimately responsible via a formal Earned Value Management System (EVMS) on requirements baselining, statusing, variance analysis and reporting to the Coast Guard customer. Most of this performance reporting by CLIN was done at Coast Guard (customer) intense interviews for the CAMS that were termed Integrated Baseline Reviews. My responsibilities at these IBRs involved technical, cost, schedule, budget, risk, EVMS dispositioning, and subcontractor performance/progress. In this position, I also helped revolutionize our SOW format and guidelines and improve our technical evaluation fact finding process. Also, while at NE&SS, among several training classes I completed were Advanced Subcontract Program Management, Risk Assessment Management (Project Mgmt.) and Dekker Trakker for our EVMS management and customer performance reporting system.

In a commercial environment, I supervised the efforts of two Buyer/Planner individuals, who did production material planning and forecasting and performed day-to-day purchase order releases from my strategic master contract agreements. I evaluated proposals from RFPs, performed price analysis, negotiated, and constructed multi-million dollar, multi-year strategic purchasing contract agreements with major mill suppliers of raw material metals and wire. My negotiation and contractual efforts were heavily involved with major Metals Commodity Market Indexes.
