AND USE OF INFORMATION FOR EMPLOYMENT
(“AUTHORIZATION”)
I have read and understood the stand-alone “Consumer Disclosure Regarding Background Investigation” (“Disclosure”) document that the Company has separately provided to me regarding consumer reports and/or investigative consumer reports (collectively, “Reports”). I authorize the Company and/or its Client(s) to obtain Reports for employment purposes from consumer reporting agencies at any time after I sign this Authorization. To the extent permitted by law, I also consent to the Company obtaining additional Reports from a consumer reporting agency for an employment purpose at any time during my employment. To this end, I authorize, without reservation, any law enforcement agency, administrator, state or federal agency, institution, school or university (public or private), information service bureau, insurance company, employer, neighbor, friend, associate, or others with whom I am acquainted or who may have pertinent knowledge, to furnish any and all background information requested. I further authorize the following information to be provided for employment purposes to the Company, its Client(s), any consumer reporting agency, and their respective officers, agents or employees to the extent permitted by law: 1. Consumer Reports and/or Investigative Consumer Reports; 2. Personally identifiable information, including but not limited to driver’s license and So cial Security numbers; 3. Information regarding my authorization to work in the United States; and 4. Insurance enrollment information.
I hereby authorize the Company to transmit this information electronically or otherwise where permitted by law. By signing below, I also am providing my express written consent for the Company or its vendors to communicate with me and provide information about my background investigation and Reports via electronic means, including email, text/SMS message, secure p ortal, or other electronic means. This includes contact via automated recordings and/or text messages to my cell phone, including those which may be sent utilizing an automatic telephone dialing system. I understand that I can opt-out of receiving text/SMS messages from the Company and its vendors at any time by emailing *******@********.***. New York State: Upon request, you will be informed whether or not a consumer report was requested by the Company, and if such report was requested, informed of the name and address of the consumer reporting agency that furnished the report. You have the right to inspect and receive a copy of any investigative consumer report requested by the Company by contacting the consumer reporting agency directly. By signing below, you acknowledge receipt of Article 23-A of the New York Correction Law. Washington State Notice: You also have the right to request a written summary of your rights and remedies under the Washington Fair Credit Reporting Act.

Contingent Worker Confidentiality and Rights Transfer Agreement To Whom it May Concern:
I am an employee of Adecco (the “Agency”) and not of (“Nestlé”), and I will be providing contingent labor services to Nestlé. I acknowledge that I will have access to software programs, information systems, business operations, sales and financial information, plans and future activities of Nestlé and its affiliated companies, financial and accounting information and practices, business and marketing information, employee information, information respecting its proprietary products and processes, ingredients, recipes, know-how, and all other information which may come to my knowledge by whatever means which is confidential and proprietary to Nestlé (collectively
“Confidential Information”). In addition, all information, conclusions, recommendations, reports, or other documents generated by me in the performance of my services for Nestlé are also Confidential Information. Information that reflects or involves the terms or conditions of my employment with Agency or assignment with, and working conditions at, Nestlé shall not be considered confidential or proprietary and I am expressly permitted to discuss wages and other terms and conditions of my assignment at Nestlé with any third party, including any government agency. If I do not sign this agreement, I will not be allowed to perform services for Nestlé as Agency’s employee. Accordingly, I agree to the following:
1. I shall hold in confidence all Confidential Information disclosed or made available to me by Nestlé or resulting from my work for Nestlé, until that information becomes a matter of public knowledge through no fault of mine. I shall not disclose to any third party nor use Confidential Information for any purpose other than as required to perform contingent labor services for Nestlé. 2. I hereby transfer all rights in all work performed or prepared by me in providing services to Nestlé, as “works made for hire.” If any of my work is not “work made for hire” under applicable law, I hereby assign to Nestlé any and all right, title and interest in and to my work, expressly including the right to sell, use, make, have made, reproduce, make derivative works of, and distribute at any time and in any manner my work. 3. I shall return all property belonging to Nestlé including, but not limited to, all computers, devices, keys, access cards, badges, files, communications, notes, records, reports, computer software or other documents (and all copies) that relate to Nestlé or its affiliates upon completion or conclusion of my services, or at Nestlé’s request.
4. I do not have an expectation of privacy in any information, communication, file or document that is transmitted, received, stored, created, edited or displayed using Nestlé’s computers, computer systems, mobile devices, phone systems or other electronic systems. Nestlé has the right to monitor, disclose, inspect and service its electronic systems and any information, communication, file or document found therein.
5. Nothing in this agreement or resulting from my work with Agency or Nestlé creates an employer/employee relationship between Nestlé and me. I am not entitled to participate in any benefit plan offered by Nestlé to its employees even if there is a judicial, regulatory, administrative or any other type of determination that I am, or at any time was, an employee of Nestlé.
