PROFESSIONAL SUMMARY

I practiced law for thirty-three years, pioneering financing mechanism for States’ Medicaid and child welfare programs. After becoming Trial Deputy for the largest Public Defender’s Office in West Virginia, I initiated the use of focus groups before every major felony case was brought to trial, obtaining as lead counsel, acquittals in the last eight of my nine trials. My career culminated in becoming the Chief Deputy Attorney General in West Virginia, where I gained extensive experience in anti-trust and consumer litigation, obtaining over two billion dollars in restitution for the State and its citizens in addition to a wide range of management duties.

CAREER HIGHLIGHTS

As a result of my team’s antitrust litigation against Master Card and Visa and getting passed the enabling legislation, the Attorney General Office was able to funds a three-year sale tax holiday for all energy star products.

Tobacco Litigation: Helped draft West Virginia’s tobacco complaint, which included consumer and anti-trust counts, which were used to by other state, and resulting in West Virginia, being recognized as contributing a unique contribution to the litigation and the State receiving an additional 180 million dollars, beyond its state share of the settlement proceeds.

Purdue Pharma: In 2003, I brought one of the first cases in the country by a government entity against Purdue for its illegal marketing practices in the sale of OxyContin and became the first party in the country to make Purdue pay. The complaint was used as a model by other entities suing Purdue
