I am pleased to make you this conditional offer of employment, where your position will be: "DRIVER." This offer is effective beginning with the date noted at the top of this letter and expires 15 days after the date noted at the top of this letter and is offered only after it has been determined that you meet our minimum hiring requirements.

The starting pay is contingent based on initial information received (i.e. experience level). As part of our total compensation package, you will be covered by a full range of benefit plans and programs. Additional information on these benefits will be provided upon reaching the eligibility date, and during orientation.

This employment offer is conditional on several factors, including but not limited to: completion and approval of a Driver Application, a signed copy of this Conditional Offer Letter, the successful completion of the Driver Academy and/or Over-the-Road Training (if applicable), the subsequent satisfactory conclusion of a personal background check including, but not limited to: criminal history, work history, motor vehicle record, drug and alcohol test history, safety inspection record and DOT medical qualification. The background investigation must be completed and the findings acceptable prior to the commencement of employment with the company. This offer is also conditional on subsequent acceptable results of a negative drug screen, medical exam, and skills evaluation. These evaluations are required of all new employees to meet Department of Transportation requirements and to comply with company policy and are paid for by the company. Our designated representative will make the necessary appointments for you. This offer is also contingent upon business factors such as a change in the company's need for Drivers. The company does not automatically exclude applicants based on criminal history, but false statements and omission in your application or in the hiring process are grounds for the company to revoke this conditional offer or terminate your employment.

All offers of employment and all continued employment with the company are mutually understood to be

"employment at will”. This means that the company has the right to terminate your employment at any time, for any reason, with or without notice, just as you have the right to terminate your employment with us at any time for any reason. It is also mutually agreed that the terms and conditions of employment with the company may be modified at the sole discretion of the company with or without cause, and with or without notice. Examples of the types of terms and conditions of employment which are within the sole discretion of the company include, but are not limited to, the following: promotions, demotions, transfers, hiring decisions, compensation, benefits, qualification, discipline, or any other term or condition of employment.

No one has authority to make any arrangement for employment other than for employment "at will" or to make any agreement limiting the company discretion to modify terms and conditions of employment except the President of the company and then only in writing personally signed by him. No implied contract concerning any employee related decision or term or condition of employment can be established by any other statement, conduct, policy or practice. This agreement is the sole and entire agreement between the employee and the company regarding this subject.
