Delivery Driver Agreement

To become and remain a delivery driver, I understand and agree that while on duty for American West Restaurant Group (AWRG): I will:

• Maintain auto insurance as required by the state and AWRG.

• Provide proof of insurance for which I am named on the policy

• Not use any vehicle for which proof of insurance has not been accepted by my RGM

• Obey all traffic regulations and wear a seat belt at all times.

• Notify my RGM immediately if I am involved in an on-duty accident or if a change occurs in my driving privileges or auto insurance coverage.

• All vehicle accidents that occur while working must be reported to your Restaurant General Manager as soon as you are able

• Do not continue to the next delivery or clock out for the day before reporting the accident

• You are responsible for reporting all vehicle accidents to your insurance carrier and should follow accident- reporting procedures accordingly.

• Accidents – Preventable/Cited-In general, accidents will be considered preventable if you:

• Make a specific driving error

• Fail to use good judgment

• Fail to drive ‘defensively’

• Violate traffic law or company policy

• All on-duty vehicle accidents are classified as preventable until the HR Department reviews them you will not be allowed to drive for AWRG until this review has been completed. The HR department may require proof that the driver is not at fault, this may include but is not limited to a police report or no-fault liability letter from either insurance provider. Proof of no-fault must be provided within 30 days of the incident, failure to do so could result in termination.

• In the event that a driver receives a citation for a moving violation arising out of accident, the driver may be suspended upon receipt of the citation, and will not be eligible to return to driving duties unless the driver is found not guilty or the citation is dismissed for lack of evidence

• Regardless of whether or not a driver receives a citation, if Human Resources conclude that the driver could have prevented the accident, the driver will be permanently barred from all driving duties.

• Display Pizza Hut signage on my vehicles as required only while on duty.

• One of the tactics we have to growing sales is ensuring that we get the Pizza Hut brand visible to as many customers and potential customer as possible. It is a proven fact that car toppers will drive sales and delivery transactions when executed properly

• Car toppers need to be illuminated at the beginning of the shift

• Must report to the manager in charge should the car topper be damaged or stolen while in use

• Must follow the mounting and removal instructions located on the car topper

• Keep my vehicle clean and in good repair while driving for AWRG.

• Pass my vehicle safety check when hired and during each reinspection I will not:

• Operate a vehicle under the influence of chemicals or alcohol or store prohibited substances in my vehicle.

• Carry any passengers, unless instructed by my Manager in Charge

• Carry firearms or other weapons.

• Smoke, eat, drink, talk on cell phone, text on cell phone, or wear headphones while driving

• Resist or chase a robber

• Display any offensive or inflammatory flags, signs, or decals on my vehicle I understand that:

• I will be reimbursed at a flat rate for each order delivered in my vehicle. (Please ask your manager for the current rate and to review the driver reimbursement policy.)

• I may be terminated or ruled Ineligible after if the following conditions exist:

• I do not maintain an acceptable driving record

• I cause an accident while on duty with AWRG

• I leave the scene of an accident

Delivery Driver Agreement

• I drive while intoxicated/under the influence/and/or refuse to take a blood alcohol test

• I Illegally transport/possess alcohol or drugs

• I flee a police officer

• I recklessly drive, including drag racing

• I use a motor vehicle during a felony

• I am responsible to any degree for a fatal accident

• I am habitual offender or frequent violator

• It is my responsibility to check my auto insurance to ensure that my policy covers bodily injury and property damages to others, in the event of an accident while on duty.

• No insurance coverage is provided for any damages that may occur to my vehicle and, that I have to comply with any state laws that require me to carry auto liability insurance. MVR Reviews:

MVR reviews will be automatically conducted on every delivery driver before hire and any employee who clocks in as a driver 2 times a year to ensure they remain in compliance with the Company's acceptable driving standards. Drivers and all employees who drive are required to sign an MVR acknowledgment before hire and 2 times a year prior to the MVR review. Driver MVR Scoring Criteria

Score as Eligible if any of the following conditions exist:

• Name and license number match, or name is a reasonable match with minor spelling difference or nicknames.

• Last name does not match, but it is reasonable to assume it is a previous name

• Clear record

• No more than 1 moving violation in the last year.

• 2 or less moving violations within the last three years Score as Ineligible if any of the following conditions exist:

• Driver not found or not a driver

• Subject has ID record only

• 2 or more moving violations within the last twelve months

• 3 or more moving violations within the past 3 years

• Any alcohol/drug related conviction

• Current expired, revoked or suspended status

Drop Box Policy

Delivery drivers are responsible for providing a pad lock for their lock box. Drivers who show up to work without a pad lock will be sent home to get a pad lock.

All managers and other employees must follow the following guidelines:

• It is the responsibility of the MOD to assign the delivery driver a drop box for that shift.

• Lock boxes are never allowed to be shared.

• Delivery driver lock boxes are designed to allow delivery drivers to place their funds after each delivery securely and to prevent others, including MOD, from gaining access to the funds in the boxes.

• Driver is to keep the lock key in their possession at all times. There should not be any extra keys that are brought by the employee to the store. Only one key per pad lock.

• Both MOD and delivery driver must conduct the “make a drop” function to drop funds in safe. Delivery Driver Agreement

• A pair of bolt cutters sufficient to cut off the locks should be available to the AC in the event a delivery driver’s key is lost during the shift.

• Boxes will be secured in plain sight of employee working in the back of the house.

• When not assigned to a driver, boxes will not be locked.

• Individual delivery driver boxes are not allowed to exceed $150.00

• If at any time the lock boxes are compromised, the MOD will begin cashing drivers out after each delivery from the assigned cash register.

• Delivery drivers will not carry more than $20.00 in cash while on a delivery. It is the responsibility of the delivery driver to ensure they do not exceed this $20.00 limit.

• Immediately upon return from a delivery, the delivery driver will put all funds received including checks & Credit card slips from the delivery transaction, less their change fund, into the lock box which has been assigned to them. It is the responsibility of the delivery driver to maintain their change balance.

• Deliver driver must perform a safe drop when “make a drop” message appears when tagging in. Message appears when drop box reaches $150.00

• The delivery driver will not be allowed to be dispatched for the next delivery without having performed the “make a drop”. It is the responsibility of the driver to ensure they do not go on a delivery without performing the “make a drop” with function with the MOD.

• I have read and understand the above guidelines. I understand that failure to strictly adhere to the above guidelines will result in disciplinary action up to and including termination. Failure to comply with this Delivery Driver Agreement may lead to progressive discipline up to and including termination regardless of the severity of the failure to comply.
