Dear Keith,

We are pleased to offer you the following position with Commercial Metals Company (“CMC”). This letter is to confirm your acceptance of our conditional offer and to outline the basic terms of employment. Specifically, our offer includes the following: Title: Rebar Fabricator

Location: Cincinnati Rebar

Start Date: TBD

Reporting To: MICHAEL W STANIFER

Base Pay: $19.25 hourly ($40,040 if annualized)

Bonus: You will be eligible to participate in the Company’s P&P Bonus program. Bonuses are based on the Company achieving its financial targets. CMC typically pays annual bonuses several months following the fiscal year end, August 31. If you are actively employed as of the date of the bonus payment and were hired on or before June 3rd of the fiscal year, you will be eligible for a target annual performance bonus of 5% of eligible earnings. Bonuses may be prorated based on your start date. The bonus payment and amount are at the sole discretion of CMC and CMC reserves the right to modify, amend or terminate its bonus programs at any time.

Vacation: After 90 days of service, you will be eligible for one week (40 hours) of vacation for use until your first anniversary. Following your first year with CMC, your full-time employment anniversary date determines your eligibility for vacation. Benefits: You will be eligible, subject to the eligibility requirements of each plan, to participate in all benefits provided to CMC employees. Benefits to include, but are not be limited to, CMC’s medical, dental, vision, life, Accidental Death & Dismemberment, Short- & Long-Term Disability, and 401(k) plan. Conditions: This offer of employment is conditioned upon: (i) your completion of CMC’s application of employment, (ii) your written acceptance of this offer (submitted via online system or email) that will expire in 1 day(s), (iii) your successful completion of any drug test and/or physical examination required of you by CMC – please complete this step within 48 hours or 2 business days of being notified your test and/or exam has been arranged, (iv) a background check, and (v) your execution of all standard ethics, non-compete, and other policy documents provided to you by CMC. General Understandings: Nothing herein will be construed to change the “at will” nature of your employment with CMC. This means that either you or the Company may end the employment relationship at any time for any or no reason, without procedural requirement. Neither this letter nor any other Company communication shall create any contractual obligation to you. The Company reserves the right to modify the terms and conditions of employment at any time.
