1.CERTIFICATE OF COMPLETION OR A CERTIFICATE OF OCCUPANCY, WHICHEVER OCCURS FIRST. A COPY OF THESE CERTIFICATES SHALL BE FURNISHED TO THE SUBCONTRACTOR IMMEDIATELY UPON EXECUTION.

2.THIS SUBCONTRACT EXPRESSLY PRECLUDES INDEMNIFICATION’S OF THE GENERAL CONTRACTOR FOR ITS OWN PASSIVE AND ACTIVE NEGLIGENCE AND EXCLUDES ANY REQUIREMENT BY SUBCONTRACTOR TO PROCURE FOR THE GENERAL CONTRACTOR “ADDITIONAL NAMED INSURED” COVERAGE TO SUBCONTRACTOR’S COMPREHENSIVE GENERAL LIABILITY POLICY. SUBCONTRACTOR RESERVES ANY AND ALL SUBROGATION RIGHTS IT MAY HAVE AT LAW OR EQUITY FROM RESPONSIBLE PARTIES.

3.SUBCONTRACTOR ASSUMES NO LIABILITY OR RESPONSIBILITY FOR MATERIALS THAT BECOME STAINED, SCRATCHED, BROKEN, OR OTHERWISE DAMAGED BY OTHERS AFTER INSTALLATION. DAMAGE CAUSED BY OTHERS AFTER INSTALLATION BUT BEFORE ACCEPTANCE OF THE WORK IS THE RESPONSIBILITY OF THE OWNER/BUILDER/GENERAL CONTRACTOR.

4.THIS SUBCONTRACT EXCLUDES, AND THE SUBCONTRACT ACCEPTS NO RESPONSIBILITY FOR, THE INSTALLATION OF PROTECTIVE COVERING OF INSTALLED GLASS AND METAL DURING CONSTRUCTION NOR THE CLEANING OF GLASS AND METAL SURFACES.

5.NO UNCONDITIONAL LIEN RELEASE WILL BE SOUGHT BY THE GENERAL CONTRACTOR UNTIL PAYMENT IS RECEIVED. LIEN RELEASES WILL BE PROVIDED IN ACCORDANCE WITH CIVIL CODE SECTION 3252(D) 1,2,3,4.

6.STANDARD EXCLUSIONS TO BECOME PART OF CONTRACT WITH THE GENERAL CONTRACTOR.
