RELEASE WAIVER AND QUITCLAIM
WITH CONFIDETIALITY AGREEMENT
I, BARNIDO, CHARIBELLE, of legal age, with residence address at 88 Olivarez Compound, San Isidro, Sucat, Parañaque City, after having sworn in accordance with law, attest that I agree to the termination of my employment at W-Tech Solutions Inc. (“Company”) due to retrenchment/redundancy and state that:
1. I have been fully paid all my salaries, allowances, and other benefits that are due to me up to September 16, 2020, in the total amount of Php 27,249.58, which I have duly received to my full satisfaction, representing all my privileges, benefits, emoluments, and entitlements, including but not limited to my full compensation, separation pay, pro-rata portion of my 13th month pay, and the monetary equivalent of all benefits which may be due to me from the Company under Philippine labor laws, existing agreements and/or company practices or policies, as well as claims, demands, and benefits of whatever nature, which I have, or may have, arising from or relating to my employment, as evidenced by my signature on this document, whether such amounts are due to me by virtue of my contract of employment or any law, rule on equity, company policy, program and/or practice. I acknowledge and admit that I am not entitled to further benefits of any other kind of emoluments, either by law or equity. 2. For and in consideration of the foregoing, I release, remise, waive, and forever discharge the Company, its principals, shareholders, directors, officers, employees, representatives, and successors- in-interest from any action, whether civil, criminal, administrative, or others, or from any claim of any kind or character or from any right or demand whatsoever, in law or in equity, such as, but not limited to salaries, allowances, dividends, other benefits or from any right or demand whatsoever, that I may now have or may acquire in the future and/or that my heirs, executors, or administrators may have by reason of any matter, cause, or thing whatsoever arising out of or incidental to my employment with the Company or due to the cessation of said employment.
3. I declare that I have no cause of action whatsoever against the Company, its subsidiaries, affiliates, related companies, principals, shareholders, directors, officers, employees, representatives, and successors-in-interest in respect of any matter incident to or arising out of my employment or resignation. Even if I am awarded any claim under any law or any order of competent authority, the consideration mentioned in Clause 1 shall be considered full and final settlement of any and all such claims. 4. I shall render all cooperation to the Company that it may deem necessary and I obligate myself to turn over and account for all records, books, money, properties, and assets of the Company that are in my possession or have been entrusted to my custody. I shall delete or destroy all copies of records, documents, and data, including but not limited to email and text messages that I received, in my possession or in my files as a result of my employment with the Company. 5. I will not at any time in any manner whatsoever, directly or indirectly, disclose to any person or entity any information of any kind relating to the business or operations of the Company, its shareholders, directors, officers, employees, representatives, clients, and successors-in-interest, including but not limited to, information concerning their plans, processes, or data of any kind which I acquired, learned, or received during my employment with the Company. 6. I agree that I will not make any statements or take any action which may, directly or indirectly, be reasonable construed to be derogatory of the Company, its subsidiaries, affiliates, related companies, principals, shareholders, directors, officers, employees, representatives, successors-in-interest, businesses or reputations.
7. I have personally read this instrument entitled Release Waiver and Quitclaim with Confidentiality Agreement, and fully understood every word of it and its meaning, and have affixed my signature voluntarily and freely with the full and complete knowledge of the meaning and intent of this Agreement and my rights under existing laws and rules on equity, without anyone or anything causing undue influence on me, coercing me, and forcing me through fraud, machinations, violence, or threats.
