Obtained dismissal of Plaintiff’s bad faith, unfair or deceptive trade practices, and punitive damages claims after oral argument premised on a novel application of the North Carolina Administrative Procedures Act that had yet to be recognized under the state's caselaw o Poindexter v. Obtained dismissal of Plaintiff's declaratory judgment and bad faith claims based on novel interpretation of the North Carolina Declaratory Judgment Act
