The Hospital for Sick Children (SickKids)

Toronto, Ontario

Dear Members of the Hiring Committee:

Application: Legal Counsel

Please accept the following letter and attached resumé as an expression of my keen interest in the position of Legal Counsel at SickKids. My unique combination of experience, knowledge and skills is well-suited to effectively carrying out the responsibilities of this position. I have extensive experience drafting and negotiating high quality commercial and information sharing agreements in the public sector. My areas of expertise include freedom of information and privacy along with big data and analytics. I am highly collaborative in approach and have excellent communication, drafting and interpersonal skills. Former clients have great respect for the high standard of client- focused service and the sound judgment and leadership qualities that I bring to my work. Specific qualifications for the position are set out below. Drafting and Negotiating Commercial Agreements

I have five years of experience drafting and negotiating various types of commercial agreements. Some of these agreements were for third party services, including information technology services, and others were for information sharing. In my most recent role as in-house counsel with a Crown corporation, the Canadian Air Transport Security Authority (CATSA), I negotiated and drafted agreements with companies providing screening services at airport checkpoints across Canada. Other agreements involved the provision of professional services and the exchange of information, often of a confidential information, between CATSA and airlines and airport authorities. While in- house counsel with the Liberal Party of Canada from 2014-2017, I negotiated and drafted a large number of agreements. Many of these agreements involved procuring services related to information technology, including big data analytics. I have excellent drafting and negotiation skills. Miy advice in relation to contracts is always clear, concise, practical and strategic. In addition to contracting experience, I have participated in numerous negotiations with regulators investigating complaints into, for example, possible conflicts of interest involving Members of Parliament. I am well prepared for any negotiation and highly persuasive.

In addition to drafting agreements, I have done extensive work developing sound policies and best practices in the privacy area. While with the Treasury Board of Canada, for instance, I developed government-wide standards protecting privacy in the use of web analytics. Privacy

I am a subject matter expert in privacy. Much of my career as an analyst and lawyer over the past eight years has had a privacy focus. At CATSA, for example, I provided all sectors of the organization with authoritative legal advice on issues including the effective management of privacy breaches in compliance with government-wide policies and guidelines, as well as the proper 2 P a g e

safeguarding of personal information. I also collaborated with the privacy team to promote an effective privacy compliance culture within the corporation and trained staff on privacy. I have also worked in the field of digital privacy. While with the Chief Information Officer Branch of the Treasury Board Secretariat of Canada, I gave concise and sound advice on issues including how to protect privacy in the use of web-based analytics. I worked collaboratively with internal and external stakeholders including Via Rail and the National Arts Centre, on the web analytics’ initiative which resulted in the issuance of a clear and practical government-wide directive on privacy and web analytics. I’m familiar with emerging technologies such as the cloud and mobile technology and the associated privacy challenges.

Skills

In addition to skills already outlined above, my communication skills, both oral and written, are superior. I’m also highly organized and decisive.

One of my greatest strengths is my team approach. While a dynamic and innovative leader, I am very much a team player. I enjoy people, am patient, and appreciate sharing ideas and working collaboratively to produce positive results.

Healthcare Context

I have a longstanding interest in, and knowledge of, the healthcare sector in Ontario. In terms of health privacy, I am currently taking a certificate course in privacy and information management in health from Osgoode Hall Professional Development. In the fall of 2019, I moved to Toronto for family reasons. I would welcome having an opportunity to discuss how my expertise would enable me to make a positive contribution as Legal Counsel with SickKids.

Regards,

Leslie Hardy
