Terms & Conditions

By using FAYSAL BANK LIMITED (FBL) WhatsApp banking channel, you agree to be bound by FBL’s Terms

& Conditions governing use of FBL’s WhatsApp Banking Channel. This is necessary for you to use the WhatsApp messenger platform.

1. Faysal Islami WhatsApp Banking Channel means the banking channel, which will be used by you, the accountholder for general query management, customer support, Funds Transfer (Within & outside the Bank).

2. Service

Service(s) means banking products and services, provided by FBL you, itself or through, Services Provider(s), and WhatsApp Channel, from time to time. 3. Personal Information

3.1. You hereby authorize FBL to use any information shared by you on Faysal Islami WhatsApp Banking Channel for provision of Services to you by FBL.

3.2. The Bank shall preserve the secrecy of all information. Notwithstanding the obligation to preserve the secrecy of your bank account(s), you hereby irrevocably authorize the Bank to disclose, as and when the Bank is required to do so in order to comply with the applicable laws (including but not limited to disclosures for the purpose of credit review of any Account service/s or credit facilities received by you from the Bank whether singly or jointly with others or otherwise), any information relating to you as t accountholder, your Account(s) or other assets or credit facilities whatsoever held on your behalf to: 3.2.1. The head office, affiliates or any subsidiaries of the Bank, its head office or any other branch of the Bank or over any other person(s) under a duty of confidentiality to the Bank. 3.3. Any exchange, market or other regulatory body having jurisdiction over the Bank, its head office, or any other branch of the Bank or over any transactions affected by you in your account. 3.4. Any party entitled to make such a request.

3.5. Any person with whom the Bank or proposed to contract with regard to the sale or transfer or sharing of any of its rights, obligations or risks under the terms and conditions. 3.6. Any person (including any agent, or third-party service provider) with whom the Bank contracts or proposes to contract with regard to the provision of services in respect of the Account(s) or in connection with the operation of the Bank’s business.

3.7. Any person employed with or engaged an agent by, the Bank or its head office or affiliates, including any relationship officers for the purposes of or in connection with interactions with the accountholder or providing services to accountholders or processing transactions pertaining to your accounts. 3.7.1. Any government/regulatory/judicial authority/agency in case of default. 3.8. You are responsible for providing and maintaining accurate and updated personal information, and for safeguarding your account information. We understand you have authorized FBL to verify and authenticate your banking and personal information, at any time. FBL will not be liable for any loss or damage arising from your failure to comply with and/or complete the requirements of FBL. 4. Security

4.1. We maintain high standards of security. You agree and warrant that you will use your mobile device safely and you will not share your phone, connected via our network, let anyone else access your phone/devices, or do anything else that might jeopardize the security of your connection. If you hand over a device with the FBL WhatsApp Self-Service Banking Channel installed to another individual, you should lock and secure the device before doing so. FBL shall not be liable for any damages or losses suffered as a result of breach of any of the actions stated above, until you have reported to FBL any damage or loss of your mobile device

4.2. You acknowledge that you are fully aware and cognizant of the various risks (e.g., technical forgery, hacking, cybercrimes, etc.) inherent and associated with using Faysal Islami WhatsApp Banking Channels and various fraudulent activities that may arise from and out of any transmissions or communications and you accept such risks. The Bank shall not be liable for any risks related thereto; and you hereby fully, irrevocably waive release, discharge, and relinquish the Bank from any and all claims, obligations and rights whatsoever and howsoever arising, that you may have against the Bank (if any) which arises or may arise as a result of the Bank acting or refraining from acting on any notifications received by the Bank under these Terms and Conditions through Faysal Islami WhatsApp Banking Channel. 4.3. You acknowledge you understand that FBL shall never ask about their personal information on phone or through email, and the Customer also agrees and acknowledges that FBL shall in no way be held responsible or liable if you as the Accountholder incurs any financial loss and/or damage as a result of his/her personal information or credentials (such as User ID, Password, PIN, OTP, etc.) being disclosed by the Accountholder themselves regarding their Account(s) in any manner whatsoever, and the Accountholder agrees that he/she shall fully indemnify and hold FBL harmless in respect of the same 5. Third Party Services

We do not endorse any third-party services. Third party providers of websites and applications

(including WhatsApp) accessed by you through the Service are accessed at your own risk, and we have no liability for third party services. If third party websites or applications (including WhatsApp) cause any problems or harm, you should seek redress directly from the third-party provider of those services. We have no responsibility in such matters and cannot assist you regarding the same. Third party providers of websites or applications (including WhatsApp) that you access through any network/ mobile phone number are subject to and governed by their own terms and conditions. It is your responsibility to read and adhere to such terms and

conditions.

6. General

6.1 These Terms apply generally to the use of any or all of FBL’s services via/through FBL WhatsApp Self- Service Banking Channel and may also be subject to terms and conditions Governing bank accounts as well as terms and conditions governing other FBL products and services, as the case may be. 6.2 FBL may engage or otherwise cooperate with affiliates, suppliers, partners and other third parties in connection with the Service, and, where applicable, “FBL” or “we” shall also be understood as a reference to such third parties.

7. The Service

7.1. FBL’s Service consists of digital products and/or services [Financial (Funds Transfer within & outside the Bank) and Non-Financial (Balance Inquiry, Check Account Statement and more)] distributed over the internet to individual consumers for private use. Such Services are accessible at our websites (the

“Website”) and, for certain Services on your own device(s) after you have installed it. 7.2. The Bank shall take care to ensure that credit and debit entries are correctly posted in the Account. In the event of any error, the Bank reserves the right to make correct adjusting entries and recover any amount due from the Accountholders, in accordance with these terms and conditions. 8. User Content and Submissions

8.1. FBL’s services and/or WhatsApp Self-Service Banking Channel may allow you to submit, post or display content, such as information, data, text, software, music, sound, photographs, graphics, videos, advertisements, messages or other materials (“User Content”). You are solely responsible for such content. FBL may review and remove any User Content that, in its sole judgment, violates the Terms and Conditions, applicable laws, or generally accepted practices or guidelines in the Jurisdiction. 8.2. Prohibited User Content under the Terms includes, without limitation, content which: 8.2.1. is offensive, such as User Content that engages in, endorses or promotes racism, bigotry, discrimination, hatred, harassment or physical harm of any kind against any group or individual; 8.2.2. involves the transmission of “junk mail”, “chain letters” or unsolicited mass mailing, “spamming” or

“phishing”;

8.2.3. Promotes or endorses false or misleading information or illegal activities or conduct that is abusive, threatening, obscene, defamatory or libelous;

8.2.4. Promotes or endorses an illegal or unauthorized copy of another person’s copyrighted work; 8.2.5. Contains restricted or password only access pages or hidden pages or images; 8.2.6. Displays or links to pornographic, sexually explicit or any other indecent material; 8.2.7. Solicits passwords or personal data from other users; or 8.2.8. Violates the rights of or harms or threatens the safety of other users or the Service. 9. Warranties and Disclaimers

9.1. FBL warrants that it will perform its obligations in a professional manner in accordance with applicable laws and make reasonable efforts to keep the required service operational. 9.2. The Service is provided “as is”. You acknowledge that the Service is not error-free. FBL makes no warranties, expressed or implied, with respect to the availability, merchantability, fitness for a particular purpose, non- infringement, accuracy, completeness, performance and quality of service of FBL’s WhatsApp Self-Service Banking Channel or otherwise. 10. Liability

10.1. FBL (including, but not limited to, its shareholders, executives, officers, affiliated companies, partners and their contractors, officers, directors and employees) shall not be liable for any damages, whether arising under law, contract, warranty, indemnification, tort or otherwise, including, without limitation, incidental and consequential damages, loss of profits or business opportunities, or damages resulting from loss of data or loss of access to the Services or otherwise. 10.2. FBL is also not liable in the event of loss by you if you share confidential banking information with another person or if you allow any other person to use their registered mobile number. 11. Indemnity

11.1. You agree to indemnify, defend and hold harmless FBL (including, but not limited to, its Shareholders, executives, officers, affiliated companies, partners and their contractors, Officers, directors and employees) from all claims, liabilities and expenses (including attorney’s fees) that arise from your misuse of services in breach of the Terms and Conditions or applicable laws. 11.2. FBL reserves the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you. You shall cooperate in good faith with FBL in asserting any available defenses. 12. Force majeure

Force Majeure means any circumstances beyond the reasonable control of either party, including, without limitation, fire, explosion, strikes or other labor disputes, riots or other civil disturbances, voluntary or involuntary compliance with any law, order regulation, recommendation or request of any governmental authority, and errors or downtime in networks, power supply, gateway or similar failures of communication. Neither party will have any liability, other than for the payment of money owing, for their failure to perform any of their contractual obligations arising out of or in connection with events of force majeure.

13. Termination

13.1. FBL WhatsApp Self-Service Banking Channel may be deactivated anytime through your personal account settings on WhatsApp

13.2. FBL may stop providing service to you, or add limits to your service, if you act in breach of the Terms or applicable laws, your right to use service and access its content will in any event immediately, without notice, terminate without refund of any fees.

14. Changes

14.1. The bank will serve a written notice of changes to these terms and condition to its customer’s at- least 30 days before the changes take effect; in either of the following ways: a) Direct Communication (e.g. email, SMS or letters) b) Display of Terms and Conditions in the Branches c) Notice in the media (including public notices)

d) Notice on banks’ website; or by any electronic banking channel used by its customer 14.2. We encourage you to check the Website regularly. If you do not agree to the amendments, you should discontinue your use of the Service. Your continued use of our services will be considered as your agreement to the terms and conditions

15. Partial Invalidity

If any provision of the Terms is declared invalid or unenforceable by a court or other binding authority, the remaining terms (or parts), conditions and provisions shall continue to be valid and enforceable to the fullest extent permitted by law

16. Language versions

Any translations of the Terms from English into another language are made solely for your convenience. In the event of discrepancies between different language versions, the English version shall prevail. 17. Choice of Law and Dispute Resolution

17.1. The Terms shall be governed by and interpreted in accordance with Pakistan laws. Any dispute, controversy or claim arising out of or in connection with the Terms shall be subject to the jurisdiction of the Pakistani courts in the Islamic Republic of Pakistan as the legal venue. 17.2. In case the customer has any concerns with or related to the Channel, the customer can raise their query to FBL via FBL Helpline: 021-***-**-**-** to register their query or complaint for resolution.
