If you send a text message requesting information, you agree that we will respond in one or more text messages. You represent that you have the authority to agree to receive text messages on the mobile (cellular) phone number that you provided to us, or from which you sent the text request to us. Message frequency is based on the frequency of your use of UPS services or the frequency of questions, requests, updates or other information we receive or send regarding UPS shipments. Standard message and data rates may apply. Text messaging is not available in all areas. Not all mobile devices or carriers are supported. UPS and the mobile carriers are not liable for delayed or undelivered messages. To opt out at any time, reply STOP via text message.

I acknowledge that my participation in the Texting program, and the related use of my personal device for business purposes, is entirely voluntarily, and that I may opt-out at any time. I also acknowledge and agree that I am responsible for all costs and expenses associated with the use of my personal device in connection with the Texting program.

I further acknowledge Texting should be limited to essential work tasks performed during the employee’s scheduled workday. This limited texting must only occur while the employee is logged into the timecard system, and is “on-the-clock,” in order to ensure that the employee is paid for this work time. Employees may not perform any work during their meal or rest periods, including activities such as responding to work-related communications or training, sorting, loading, delivering, or scanning packages. Further, employees should refrain from texting while operating motor vehicles.

All start time changes must be in accordance with the applicable labor agreement, local supplement, or addenda. With the exception of text or other communications with employees related to start times and driver meet points, all other communications with employees related to work assignments and job duties must only occur while the employee is logged into the timecard system, and is “on-the-clock,” in order to ensure that the employee is paid for this work time. UPS does not permit unpaid work. Employees should never perform any work before their scheduled start time, during a meal or rest period, or after clocking out, unless a manager or supervisor specifically instructs them to do so. If instructed to perform work tasks, the employee must clock in so that they will be paid for that work.

I hereby grant to United Parcel Service of America, Inc. (“UPS”) the unlimited, irrevocable, and exclusive right and license to use my name, texts, photographs, video recorded images, or other provided information, submitted in connection with my employment with UPS and use of TextReach, for the purposes of workplace communication and other official UPS business, without further compensation. UPS shall be the sole and exclusive owner of all rights in and to the images.
