Duties/Responsibilities: Management position involved in details of enforcement activities and operations expertise to reduce incidents and maintain compliance. Assist district manager in assembling information to distribute to the stakeholders in the district as well as information required by MSHA and the Department of Labor. As District Accident Coordinator, lead and coordinate the gathering of information to be used in official reports for MSHA. Accountability activities include preparation and collection of information to assist PEIR, Program Evaluation and Information Resources and Office of Accountability Review. Information from reports are used for training the district’s coal mine inspectors to enhance the effectiveness of the enforcement activities of the district. Conference Litigation Representative GS-13

Duties/Responsibilities

As a CLR, met with coal mine representatives during enhanced conferences to make proposed settlement requests to Administrative Law Judges. These conferences are the result of contested civil penalties assessed to citations received by the coal mine operator issued by authorized representatives of the Secretary of Labor during mine inspections. Posess unlimited appearance certification.status Have presented MSHA cases before Administrative Law Judge. Responsible for setting up depositions, preparing witnesses and developing strategies to settle dockets. Also experienced in prepaing settlement motions. Case preparation for dockets to be held before an Administrative Law Judge (ALJ) included; deposition preparation and depositions for coal mine inspectors, miners and agents of the mine operator. Also responsible to conduct research into case law for conferences with mine operators utilizing West Law search engines and other tools that are available. Conducted docket analysis for the MSHA solicitors to aid in case preparation. Inspection of coal mines as directed by the District Manager including compiling all notes that are taken during and as a result of the inspection.

Accomplishments:

Jan - Feb 2010 Completed major Part 50 Audit of Large Mining Operation involving over 2000 accidents over a 5 year period.

Was temporarily assigned as a Ventilation Supervisor to District 8 for a 2 month period of time Nov - Dec 2009.

Lead accident investigator in 5 fatal and 3 serious non-fatal accident investigations. I was assigned the double fatalities at Dotiki and Equality. This involves gathering and disseminating information from interviews and site investigation and preparing a written report that is MSHA’s permanent record of the events.

Accomplishments:

Was successful in reducing the number of reportable roof falls and injury accidents related to the roof in the mines of District 10.

Made recommendations that led to changes to roof control plans based upon data I collected and studied that specifically targeted individual mines with special condition issues.

Helped mines become compliant with 120 psi seals after new regulations became effective following the Sago disaster.
