Profile: John is an attorney with 38 years of litigation, negotiation and broad experience in field of labor & employment law, intellectual property, contracts and general civil and criminal law. He has excelled in the public and private sector executive/management roles as general counsel of large international union and as executive director of civil rights agency directing and supervising attorneys and other staff in investigation and prosecution of cases. He also has substantial trial experience in jury, bench and administrative trials in various federal and state courts and agencies.

Skills

Traditional Labor Law- have represented labor unions, employers and the NLRB in all aspects of traditional labor law including representation issues pre and post-election, bargaining unit issues, campaigning, strikes and other work stoppages including injunctive relief, contract negotiation of both initial and successor agreements, grievance and arbitration (including as arbitrator) in construction, manufacturing, health care, maritime, maintenance and other industries as well as federal, state and local government contracts covering government employees.

Employment law- represented individuals, employers and unions in all other employment law actions involving Title VII, ADA, ADEA, FLSA and countless other laws counseling employers, government agencies and others as to compliance and enforcement. Have litigated cases including jury trials in all these areas including individual, collective and class actions including those seeking equitable relief in numerous federal and state courts, administrative agencies, mediations. etc.

ERISA, Intellectual Property, Personal Injury and other Legal Matters: Represented Taft-Hartley Multi Employer/Union Benefit Plans, advising Trustees and other fiduciaries on all legal compliance issues, represented Funds in countless collection actions in Federal Court for delinquent contributions, handled all subrogation claims, litigation against funds and compliance issues with U.S. Department of Labor. Copyright Infringement and Trademark Law- Represented Seoul Broadcasting System in U.S. for all copyright infringement action trying more than 10 copyright actions to judgment in Federal Court, represented small businesses in trademark actions, obtained multi-million of dollars jury verdict representing plaintiff in medical malpractice action, represented clients in various actions against government in both federal and state courts.

Government and neutral services: Worked for NLRB Division of Judges (D.C.) and General Counsel Office as field trial attorney (Region 5) performing all duties of experienced attorney including prosecuting ULP cases (CA and CB) and serving as hearing officer in both pre and post-election hearings. Represented GC in 10(j) cases in federal district courts. Appointed first Executive Director of Baltimore County Human Relations Commission setting up County’s first civil rights agency and creating investigatory and enforcement processes as well as judicial and ADR mechanisms including mediation of cases. Worked with FMCS to train 25 mediators to serve various FEP agencies; appointed Special Master for the United States Federal District Court for Maryland relating to labor, employment and ERISA matter; mediator/arbitrator for National Mediation Association (NAM); appointed to United Nations Legal Committee for International Mariner Rights.

Management and Executive Roles: Served as General Counsel to large international maritime union supervising all in-house and outside legal counsel and staff for over 11 years while managing partner of general practice law firm. Managed small law firm of 5 attorneys for over 20 years. Litigated as lead or co-counsel in federal and state litigation including arbitrations, served as chief negotiator on all collective bargaining, represented union as both management and as bargaining representative and advised and represented union in all internal union issues including LMRDA issues. As already mentioned, Executive Director of BCHRC for five years. Also served on Executive Board of Maryland State Bar, Labor & Employment Section for 12 years received distinguished service award.

Forums: United States Federal Courts in District of Maryland and District of Columbia, United States 4th Circuit Court of Appeals, United States Court of Appeals for District of Columbia. Admitted United States Supreme Court. Appeared in proceedings before EEOC and other State and Local Civil Rights Agencies, Administrative proceedings before Maryland Office of Administrative Hearings, United States Department of Labor and served as local and co-counsel, pro hac vice in numerous states and U.S. territories.
