SUMMARY OF EXPERIENCE

For clients in the solid waste, hazardous waste, and construction industries, Tim Bray provides solutions to technical and regulatory problems involving groundwater. Most of his projects involve groundwater monitoring, drainage, leachate management, and regulatory agency interaction. The principal objectives typically have been to identify effective and affordable ways to contain and manage landfill leachate, control groundwater levels to prevent or restrict contact with structures or waste, and to develop effective groundwater monitoring programs.

Mr. Bray's role in several projects has extended beyond site characterization, permitting, and monitoring, to include design, construction management, and resident engineering services during construction (design-and-build). In this capacity he has worked alongside contractors and engineers, on projects ranging in size from $10,000 to over $100 million.

In addition to the technical work, Mr. Bray has also worked with attorneys, plaintiffs, and defendants on a variety of legal matters, including cost recovery, lawsuit defense, permitting and permit violations, and damage evaluation. He is familiar with several regulatory systems, including the Federal RCRA and CERCLA programs, and the California Title 27 regulations. For example, he served as an "expert jurist" for JAMS-Endispute; working for the arbitration judge, he provided analysis of the merits of expert testimony presented by plaintiffs and two defendants. For other (confidential) clients, he has provided technical support for legal issues, including cost recovery actions.

Representative project experience includes the following:

ACME Landfill (1994, 1996 - 2000) - Mr. Bray managed construction operations during installation of 12 large-diameter leachate extraction wells in refuse fill, and subsequently assisted with construction management during closure of a 120-acre hazardous waste landfill, including installation of underground leachate collection system utilities and placement of composite GCL/HDPE cap. Simultaneously, he managed the operations of leachate collection systems and an on-site leachate treatment plant processing RCRA listed (F039) waste.

Keller Canyon Landfill (1988 - 2000) - Mr. Bray conducted several phases of field investigations to provide data for design and permitting of this large and controversial landfill. He assisted with design of the landfill and associated structures, and played major roles in obtaining permits from the San Francisco Bay Regional Water Quality Control Board, the State Water Resources Control Board (including testimony before the Board), the Army Corps of Engineers, and Contra Costa County. Subsequently, he provided on-site geological engineering services during construction, including temporary and permanent dewatering system design, development of an onsite 1,300-gpm water supply, and monitoring well abandonment. From 1992 to 2000 he continued to provide assistance with facility expansion design, operations, groundwater monitoring, well abandonment and replacement, leachate management, and wetlands mitigation.

Condon-Johnson (1995 - 2000) For this earthwork contractor, Mr. Bray designed and monitored operation of dewatering systems to allow excavation below the groundwater table at several project sites in San Francisco, including: Rankin Pump Station - excavation through 65 feet of saturated Bay mud and into Colma Sand. Provided specifications for well construction, operations, and abandonment.Moscone Center III - excavation of a 5-acre site, removing 30 feet of saturated Dune Sand, and underpinning an existing building. One Second Street and 101 Second Street - dewatered Dune Sand for pile and elevator shaft excavations and underpinning.

Confidential Client (1998) - A contractor encountered greater than expected groundwater inflows during excavation for a parking structure. At the direction of attorneys, Mr. Bray reviewed the subsurface information available to the contractor prior to construction, and the additional information discovered during excavation. The evaluation concluded that site conditions were significantly different than had been characterized in the soils reports.

Confidential Client (1996 - 1997) - This client was under Federal investigation for discharge of wastewater to a National Wildlife Area. Working with a defense attorney, Mr. Bray developed a model to estimate the quantity of water potentially discharged during wet weather overflows from a pond storage system.

(Confidential) County (1997) - The County was being sued for allowing discharge of water draining from old mine workings into a nearby creek. Working for the County s attorney, Mr. Bray evaluated the occurrence, flow, and water quality of the drainage. This work included developing a sampling protocol for collection of samples that were split between the County and the plaintiff, and comparison of the results to Clean Water Act requirements.

JAMS/Endispute (1994) - A lawsuit brought by the owners of a shopping center against two of its tenants was referred to arbitration. Working for the arbitrator, Mr. Bray heard and evaluated expert witness testimony from plaintiffs and defendants, and provided the arbitrator with an independent expert summary. Plaintiffs and defendants reviewed and approved Mr. Bray's qualifications to act in this capacity. The matter involved soil and groundwater contamination in the vicinity of an auto-repair shop and a dry cleaning facility.

Tosco Refinery RFI (1991 - 1999) - Tosco was ordered by the EPA, the DTSC, and the RWQCB to investigate and clean up contamination from several former disposal areas. Mr. Bray was Project Manager for the RCRA Facility Investigation and Lead Hydrogeologist for continuing site characterization and corrective action work conducted by CH2M HILL. He also assisted with development of a Groundwater Monitoring Plan to comply with California Title 22 regulations, and provided litigation support, including depositions, for cost recovery efforts by Tosco.

Invoices, listing hours and expenses by category, will be submitted for each month of work. Each invoice is due and payable upon submittal. Payment terms may be negotiable for long-term work; please contact me if you will need more than 30 days.

N. B. Depositions, expert testimony, or other hearings or court appearances will be charged $150 per hour. A daily 4-hour minimum applies to all legal support activities conducted outside my office. Expenses are charged at the rates shown above.
