Employment Litigation Associate, Genova Burns Giantomasi & Webster, Newark (September 2006–November 2012)

• Litigated employment, environmental, estate, and commercial cases in N.J. and N.Y. state and federal courts.

• Assisted General Counsel of Fortune 500 Company with an internal investigation of company’s international

communication systems and policies to audit compliance with state and federal laws.

• Represented a Dubai-based technology company in restrictive covenant and unfair competition litigation against its

former chief operating officer resulting in a negotiated settlement.

• Advised diverse clients, including large corporations, closely held companies, private college, public school districts,

municipal and county governments, and non-profit organizations, on a variety of legal matters and policy issues

involving employees, students, vendors, and customers.

• Counseled employers on litigation avoidance and negotiated employment agreements and separation agreements.

• Regularly counseled employers on labor and employment laws on matters involving allegations of discrimination and

harassment, requests for workplace accommodations or leave, performance issues, wage and hour compliance, and

interpretation of contract terms.

• Advised managers on employee training, coached decision-makers on discipline and discharge of employees, and

collaborated with clients on drafting employee policies and updating employee handbook provisions.

• Represented various employers through investigation and mediation of charges/complaints filed with the New Jersey

Division on Civil Rights and United States Equal Employment Opportunity Commission.

Litigation Accomplishments

• Successfully defended Chief of Police and Township in suit filed by two police Lieutenants challenging municipal

ordinance and promotional process under the state constitution. Managed all aspects of pre-trial civil litigation.

Prepared and argued summary judgment motion before the Superior Court of New Jersey obtaining dismissal of all

four counts. Prepared briefs on behalf of Respondents and argued before the Appellate Division, which affirmed

dismissal. Prepared and filed brief with Supreme Court of New Jersey in opposition to Petition for Certification,

where the matter is pending.

• Successfully defended Public School District and Administrators in an action filed by terminated teacher alleging,

inter alia, violation of the New Jersey Civil Rights Act, CEPA, defamation, and tortious interference. Served as

second chair during the two-week jury trial in Superior Court. Prepared all pre-trial submissions, including in limine

motion and opposition briefs, voir dire questionnaire, verdict form, and jury instructions. Conducted cross and direct

examination of four witnesses during trial, including students who reported acts of child abuse and endangerment.

Judgment was awarded for Plaintiff as to one of ten counts. Prepared motions for involuntary dismissal and j.n.o.v.,

and assisted with appeal, which was ultimately successful in reversing the judgment and award against the District.

• Successfully defended County Administrator and County in Section 1983 First Amendment retaliation claim filed by

ninety five (95) union members who were challenging layoffs. Prepared and argued summary judgment motion before

the District Court, which granted the motion dismissing all claims.

• Successfully defended County and Prosecutor’s Office in several consolidated Section 1983 First Amendment

retaliation claims filed in the District Court by approximately twenty (20) police officers against their employers and

supervisors. Following exhaustive discovery, obtained a dismissal of all claims with prejudice.

• Successfully defended Chief of Police, Township Manager, and Township in an action filed by fifteen (15) Auxiliary

Police Officers and their Association alleging constitutional violations. Obtained a dismissal with prejudice on

estoppel and procedural grounds.

• Successfully defended private college in a suit filed by a former student alleging discrimination and seeking monetary

and equitable relief by obtaining dismissal from the Superior Court and affirmance by the Appellate Division.

• Defended Third Party Defendant public utilities in a 300-party environmental litigation by participating in settlement

negotiations with the NJDEP; participating in discovery hearings before the Special Master and Court; participating in

the committee formulating e-discovery protocols for all litigants; preparing discovery and pleading documents;

reviewing appellate briefs; preparing bi-monthly reports to the clients; supervising document scanning vendor during

digitization of client files; and managing a team of contract attorneys performing document review of 1.6 million page

production on Relativity®.
