I provide extensive legal advice and conduct legal analysis for management on labor relations issues,

including bargaining obligations, clarification of the bargaining unit makeup, preparations for contract

negotiations, the proper role of the union in formal discussions, grievances, and disciplinary meetings;

changes in working conditions, approval of official time, and many other issues. During the past year, I

conducted multiple labor relations briefings for the Comptroller General of the United States and the

Executive Committee on management’s legal obligations with regard to the union’s organizing campaign,

and the next steps after the union’s certification following the election. I also provided training to all

GAO managers on working in a union environment.

Since September 2007, I have worked exclusively in the area of labor relations following the election of a

union for the first time in GAO’s 86-year history. Prior to that time, I worked in both labor relations (in

preparation for the union election) and in employment litigation. I worked on a wide variety of complex

employment cases, and provided extensive advice to management on issues involving intricacies of the

Americans with Disabilities Act, the Family and Medical Leave Act, leave administration, sexual

harassment, allegations of race, sex, and age discrimination, falsification of government documents, and

the interplay of performance and conduct issues in problem employees. My major accomplishments

include: representing management in investigations conducted by GAO’s Personnel Appeals Board

involving allegations of prohibited personnel practices and/or discrimination on the part of GAO

management; assisting an Assistant U.S. attorney in the depositions of nine plaintiffs in a federal district

court class complaint involving allegations of age discrimination by GAO; conducting a far-reaching

administrative investigation of possible retaliation for protected activity; and participating in settlement

discussions and mediation sessions to resolve allegations of discrimination by GAO.

I provided expert advice and counsel to the Medical Center Director and Human Resources Management

Officer on the most complex and sensitive employee and labor relations cases. I worked intimately with

attorneys in representing management at arbitrations of grievances and appeals of disciplinary actions. I

advised supervisors and management on disciplinary actions, grievances, appeals, questions of reasonable

accommodation, and interpretation of collective bargaining agreements. I participated in and/or provided

advice and assistance on numerous administrative investigations involving allegations of patient abuse;

violation of ethics rules; falsification of time and attendance records; sexual harassment; neglect of

official duties; and numerous other matters. I prepared agency responses to the U.S. Merit Systems

Protection Board, the Federal Labor Relations Authority, EEO complaints, and Congressional inquiries.

During the final year, I served as the Medical Center Director’s personal and staff assistant as a member of

the agency-wide management team in negotiating the first national labor contract for VA Registered

Nurses. I drafted management proposals, critiqued union proposals, and attempted to resolve outstanding

issues at the bargaining table.
