ASSET MANAGER 2010-Present
Managed failed bank's loans with a face value of $270,000,000 including
loans as large as $50,000,000 at an FDIC Receivership. Loans included
partially funded construction loans and participations. Managed distressed
asset workout and litigation process. Within the first 120 days of the
Receivership negotiated settlements or releases of collateral at or above
appraised value with potential proceeds to the Receivership in excess of
$71,000,000.
CONSULTANT 2009- 2010
Worked with Banks responding to requirements of enforcement actions from
Federal Regulators including: criticized asset reduction plans; lending and
collection practices and policies; risk segmentation analysis; impairment
analysis; and reduction of concentrations of credit. Established the
overall management framework for resolution of problem loans.
CONSULTANT 2008- 2009
Asset Professional responsible for all loan participations at a closed bank
for a Receivership Assistance Contractor on behalf of the Federal Deposit
Insurance Corporation. Managed 35 loans participated with 17 banks. Most of
the loans and many of the participants were distressed. Sold and exchanged
participation interests with participants and managed the litigation of
defaulted lending relationships
Performed the contract repudiation function at a closed bank for a
Receivership Assistance Contractor on behalf of the Federal Deposit
Insurance Corporation.
CONSULTANT 2007- 2008
Ran loan reviews at financial institutions in Los Angeles, California, Las
Vegas, Nevada and Fort Pierce, Florida for Brintech, Inc., a bank
consultant. Reviewed up to 350 loans leading a team of up to four other
consultants. Ran the exit interviews with senior management of the
customer. Wrote the reports to senior management of the client containing
findings and recommendations. Performed a BSA Lookback at a financial
institution in New York State.
ATTORNEY, DEVELOPER AND INVESTOR 1994-Present
Represented builders, developers and property owners in financing,
restructuring and sales transactions up to $40 million in size;
Represented borrowers in workouts of problem loans with banks, the FDIC and
the RTC involving relationships up to $20 million in size;
Developed, with partners, various projects including a 68 lot subdivision
in Sudbury, Massachusetts; 330 rental units and a 127 room hotel in
Worcester, Massachusetts; 360 rental units and condominiums in Merrimack,
New Hampshire; and a 113 unit condominium (mill conversion) in Lowell,
Massachusetts.
FEDERAL HOME LOAN BANK OF BOSTON 1987-1994
Started as an attorney and ended as the Bank's Counsel.
Legal responsibilities included:
All issues related to the Bank's operations including wire transfers,
depository relationships, bank checks and compliance with requirements of
Bank Secrecy Act and Federal Reserve Rules and Regulations;
Regulatory issues, lending and collateral issues involving member banks;
and
All issues related to the Bank's finance functions including interest rate
swap and derivative agreements.
