. Representation of real estate developer against mezzanine lender in
action for breach of contract, fraud and estoppel as a result of
lender's failure to provide acquisition and construction financing.
. Representation of international pharmaceutical company in two
arbitrations administered by the American Arbitration Association's
International Centre for Dispute Resolution and the International
Court of Arbitration's International Chamber of Commerce; obtained
global settlement of both disputes through mediation on terms very
favorable to client.
. Representation of food distributor in an evidentiary hearing before
the Southern District of New York (Lynch, J.) to obtain a preliminary
injunction to prevent defendant, a manufacturer and distributor of
kosher food products, from terminating an exclusive distributorship
agreement between the parties; successfully obtained a preliminary
injunction on behalf of clients after a two day hearing.
. Representation of officers and directors of an Internet-based services
company in an action commenced against them in the Southern District
of New York by investors for insider trading, securities fraud and
common law fraud; prevailed on motion to dismiss, which dismissed all
claims asserted against clients (Batts, J.).
