.3يعين الطرف الثاني تحت الإختبار لمدة 0 يوم من تاريخ إستلامه العمل وإذا رغب أحد الطرفين في إنهاء هذا العقد وجب عليه إخطار الطرف الآخر كتابة قبل الإنهاء ب (7) سبعة أيام على الأقل (يجب ألا تزيد مدة الإختبار على (3) ثلاثة أشهر).
3.The second party shall be appointed under a 0 Days probation period, from the date of assuming work. If one of the two parties’ desires to terminate the contract, he shall notify the other party in writing, at least 7 days before the contract expiry date (The probation period must not exceed 3 Months).
.4 يستحق الطرف الثاني إجازة سنوية بأجر شامل لمدة 30 يوم ويتمتع العامل بالإجازة حسب مقتضيات مصلحة العمل ولا يجوز للطرف الثاني القيام بالإجازة الإعتيادية قبل إنقضاء (6) ستة أشهر على الأقل من تاريخ إلتحاقه بالعمل لدى صاحب العمل.
4.The second party is entitled to an annual leave with a comprehensive wage for 30 days according to the
necessity of work after completing at least (6) Month from the date of assuming work.

.5يستحق الطرف الثاني إجازة طارئة بأجر شامل لمدة (6) ستة أيام طوال السنة لمواجهة أي ظرف طارئ وفقاً لقانون العمل والقرارات الوزارية المنفذه له. 5.The second party is entitled for an emergency leave with a comprehensive wage for (6) days throughout the year, for any emergency purpose as per the labor law and its implementing ministerial decisions.
6.Upon application of this contract, employment of women must take into consideration the labor law and its implementing ministerial decisions
.6عند تطبيق هذا العقد يراعى في تشغيل النساء قانون العمل والقرارات الوزارية المنفذه له.
.7على الطرف الأول تحويل أجر العامل (الطرف الثاني) الى حسابه بأحد المصارف المحلية المعتمدة في التاريخ المتفق عليه خلال مده لا تتجاوز (7) سبعة أيام من تاريخ الإستحقاق.
7.The first party shall transfer the employee (Second party`s) wage to his account at one of the endorsed local banks on the date agreed upon and within a period of not more than (7) days from the entitlement date.
.8على صاحب العمل أن يمنح العامل راحة أسبوعية لا تقل عن يومين متتالين بعد خمسة أيام عمل متصلة ويجوز في الأماكن أو الأعمال التي تحدد بقرار من الوزير تجميع الراحات الأسبوعية المستحقة للعامل عن مدة لا تجاوز ثمانية أسابيع إذا اتفق العامل وصاحب العمل على ذلك كتابة وتكون الراحة الأسبوعية في جميع الأحوال مدفوعة الأجر.
8.The first party shall grant the second party a weekly rest of not less than two consecutive days, after continued five days of work.
9.The first party shall be banned from the following: :.9 يحظر على الطرف الأول القيام بما يلي أ- تشغيل الطرف الثاني في مواقع الإنشاءات والأماكن المكشوفة ذات الحرارة العالية في أوقات الظهيرة من الساعة ( 12:30 - 03:30 ) وذلك طوال أشهر يونيو ويوليو وأغسطس وفقاً لأحكام اللائحة التنظيمية لتدابير السلامة والصحة

ب- الخروج على نصوص العقد أو تكليف الطرف الثاني بغير العمل المتفق عليه في هذا العقد الا اذا دعت الضرورة لذلك وبصفة مؤقته ومع ذلك يجوز له أن يكلف الطرف الثاني بعمل غيرالمتفق عليه إذا كان العمل لا يختلف عن العمل

a.Employing the second party in construction sites and open areas with high temperatures at noon (from 12:30 to 03:30), during the months of June, July and August in accordance with the provisions of the regulations for occupational safety and health measures issued by
Ministerial Decree No. (286/2008).
b.Violating the provisions of this contract, or tasking the second party with a work which is not agreed upon in the contract, unless necessity arises and for a transitional period. However, he/she may assign the worker or the second party only if there is no fundamental difference between the new tasks and the original work he is
contracted for.
10.The first party shall repatriate the non-Omani employee to his country, after completing the work relation with him, unless the employee`s services have been transferred to another employer, and if the employee has left the work in violation of the labor law he shall be deported, in accordance with the procedures adopted by the Ministry.
.10يلتزم الطرف الأول بإعادة العامل غير العماني الى بلده بعد انتهاء علاقة العمل معه مالم يتم نقل خدماته الى صاحب عمل اخر واذا ترك العامل العمل بطريقة مخالفة لأحكام قانون العمل يتم ترحيله وفق الإجراءات المتبعة بالوزارة. 11.First party should Provide death and work injuries ..11يلتزم الطرف الأول بتوفير التأمين ضد إصابات العمل والوفاة للطرف الثاني insurance for the second party.

أ- الإلتزام بشروط العمل المنصوص عليها في هذا العقد ب- احترام الدين الاسلامي وقوانين البلاد وعاداتها وتقاليدها الاجتماعية ج- عدم التدخل بأنشطة تضر بأمن البلاد
a.Comply with the work terms stipulated in this contract. b.Respect the Islamic religion, the sultanate’s laws and social traditions and customs.
c.Not to get involved in any activities that harm the State`s security.
13.The second party shall commit to the following: :.13يلتزم الطرف الثاني بما يلي أ- التواجد في مكان العمل في المواعيد المقررة وان يؤدي عمله بإخلاص وأمانة أن يبذل في تأديته العناية اللازمة طبقا لما هو محدد بهذا العقد وطبقا لأحكام قانون العمل وأنظمة العمل المعمول بها
ب- الحرص على وسائل الإنتاج وأدوات العمل الموضوعة تحت تصرفه ويحافظ عليها بعناية
ج- القيام بتنفيذ تعليمات السلامة والصحة المهنية المقررة بالمنشأه بموجب القانون والقرارات المنفذة له ونظم ولوائح العمل وتعليماته
a.Be available at the workplace at the set timings and perform his duties loyally and honestly as per the stipulations of this contract and according to the provisions of the labor law and the systems in place. b.Take care of the production means and work tools at his disposal and preserve them.
c.Implement the occupational safety and health
regulations set at the establishment, as per the labor law, its implementing decisions and the work systems and regulations and instructions.
.14لا يجوز للطرف الثاني أن ينافس الطرف الأول أو يشترك في عمل ينافسه بعد انتهاء العقد على أن يكون هذا الشرط مقيدا بالزمان والمكان ونوع العمل بالقدر الضروري لحماية المصالح المشروعة للطرف الاول.
14.It is not permitted for the second party to compete with the first party or to participate in work that competes against him after the end of the contract, provided that this condition is tied by the time, place, and kind of work to the extent necessary to protect the legitimate interests of the first party.
.15يلتزم الطرف الثاني بالمحافظة على سرية أية بيانات او معلومات تصل الى علمه بموجب احكام هذا العقد خلال فترة تنفيذه وبعد انتهاءه وعدم افشاء او كشف او نقل اية معلومات تتعلق بهذا العقد الى اي شخص او جهة اخرى وفي حالة اخلاله بذلك تطبق القوانين والانظمة المعمول بها في السلطنة .
15.The second party shall maintain the confidentiality of any data or information pertaining to his knowledge by virtue of the provisions of this contract during its implementation and after its termination, and shall not disclose, reveal, or communicate any information relating to this contract to any other person or entity, and in case of violation the laws and regulations in force in the Sultanate shall apply.
.16يقر الطرفان بإطالعهما على قانون تصنيف وثائق الدولة وتنظيم الأماكن المحمية وكذلك قانون العمل والقرارات واللوائح الوزارية المنفذه له. 16.The parties acknowledge being aware of the Law on the Classification of State Documents and Governing Protected Places, and the Labor Law and its implementing decisions and ministerial decisions.
.17يسري قانون العمل والقرارات واللوائح الوزارية المنفدة له على ما لم يرد ذكره بهذا العقد
17.The labor law and the decisions and ministerial regulations implementing it shall be effective on whatever has not been mentioned in this contract.
.18في حال وجود أي نزاع بين الأطراف بشأن تنفيذ الإلتزامات الناشئة عن هذا العقد يتم تسويته وديا لدى الدائرة المختصة بالوزارة وفي حال تعذر ذلك فانه يتعين اللجوء الى المحكمة المختصة بسلطنة عمان.
18.In case of any dispute arising between the parties on implementing the commitments resulting from this contract, such dispute shall be settled cordially at the concerned department of the Ministry. And if this is not possible, it shall be referred to the competent court in the Sultanate of Oman.

.19في حالة وجود شروط أخرى يرغب الطرفين الإلتزام بها تحرر في ملحق أخر خارج هذا العقد دون التصديق عليها من قبل الوزارة مع مراعاة ان تكون مطابقة لأحكام قانون العمل.
19.In case the two parties desire to abide be other terms, such terms shall be included in an annex to this contract, without being endorsed by the ministry, provided that they comply with the provisions of the labor law.
.20حرر هذا العقد من نسختين باللغة العربية واللغة الانجليزية لكل طرف نسخة للعمل بموجبها ولكل منهما ذات الحجية القانونية. وفي حالة الاختلاف في التفسير يعتد بالنسخة العربية.
20.The contract is drafted in two copies in both Arabic and English languages, one copy for each party, both texts being equally authentic and in case of a divergence in interpretation, the Arabic text shall prevail.
