MacGregor, bring to the table is intellect derived from 53 years of experience at all levels of construction within an array of contract types, most bonded by surety. As concerns automated applications, all of them, no exceptions, are only as good as the information entered in them whether it be dimensional or cost relative. Grade of difficulty and idle time are not taken into consideration by any application I have come across. Scheduling programs are based on ideal conditions. Digitizers are helpful; however, drawings may not be to scale or with referenced dimensions [not read by a digitizer]. Dependence on these applications should be cautiously limited to represent a point of beginning. I can easily adapt to any software.

My labor costs estimating is based on manhours and wages as they apply to the project at hand. Estimates based on a per square foot basis is a dangerous practice. I mention labor because labor is the big variable whereas material costs can be secured. Subcontracts must be written in an exacting fashion, such that there is no doubt as to inclusions and exclusions; the same applies to some formal purchase orders. In the financial area expertise, I can easily read financial documents and find where improvements/changes need to be made.

In my experience, communication flows between all associates must be written, open, factual, timely, properly filed, and complete for the successful completion of any project. Managed/supervised construction of 3 federal schools for CAPFCE in Nuevo Laredo, Mexico. Negotiated with local unions and maintained good relations; monitored, and secured delivery of materials ordered, supervised labor crews and subcontractor (the only subcontractor was for the electrical). Responsible for preparing the monthly RFPs including photographing progress & quality; was also responsible for delivering payroll weekly in cash to union reps. Because of a rule referred to by the unions as “labor displacement”, all work was by hand. Placing fill was done with wheelbarrows & shovels, graded in 1” layers with straight edges. Compaction was done by hand, using a pipe with a heavy steel plate. All excavation was done with hand tools. Often, because of Nuevo Laredo’s intense heat, workers would faint from heat stroke in the trenches; I was responsible for their care and rehydration. Concrete was mixed on site. I personally calculated gradation of aggregates to meet compression specifications and supervised the mixing. The only equipment used was a rail elevator-bucket assembled on site to transport concrete to the upper floors and roofs. Rebars were straight bars, not pre-bent or pre-cut. Each placement of concrete would last between 24 and 36 hours all placed with wheelbarrows and finished by hand. I personally handled preparing the concrete cylinders required to test for compression strength and carried them to labs in Monterrey, Mx. Erection of steel structural members was rigged on site with steel pipes and pulleys. Hollow metal door frames were bent, cut, and welded on site. Structural steel welding was performed by our crews, under my supervision. Lead for plumbers was melted on site under my supervision. The projects required septic systems as main sewer lines did not exist. The project was of importance enough that it justified a visit and inspection of the facilities by then Mexican President Lic. Luis Echeverria Alvarez.

My initial employment was as an estimator. In three months, I was promoted to VP of Estimating, Purchasing, and Project Management. Under this position I performed all estimating from beginning to finish; this included all quantitative takeoffs, costing, sub bid and material bids tabulations, preparation of the final bid package, writing all subcontracts and formal purchase orders, initial progress schedule, expediting all submittals and shop drawings, cost coding and budgeting, conflict mediator, relations with A/E/O, monthly Applications for Payment, review and approval of materials and subcontractor payments. I was the only Estimator and Project Manager. I oversaw the performance of the superintendents and on occasion visited the jobsites to ensure quality and progress of work. Corporate Compliance was also my obligation. Met with our President, CPA, and our bookkeepers to ensure the resulting Audit was correct. ACHIEVEMENTS:

AS VP of an entire department, I was the only Estimator and the only Project Manager. Not once did I ask for HR support; if we had grown to where I could not handle things myself, I would have asked for support without hesitation. Because of this, our overhead expenses were much lower than those of our competitors. It gave us an edge.

As President I oversaw, supervised, and made critical decisions for the entire operation. One area I always handled myself was Estimating. I also Project Managed most of our Projects. I prepared Applications for Payment, Change Orders and mediated all conflicts or misinterpretations. I supervised all jobsites for progress, craftmanship, and quality of materials. I dealt with all legal issues, surety negotiations, insurance limits required by the projects, quarterly and annual financial statements, and capital investments. I reviewed all miscellaneous purchase orders, authorized all those payments due, and worked diligently to keep our Free Cash Flow robust. LYDA, INC.

As Senior Estimator I was assigned the more complex projects. My estimates were exacting, well detailed, well referenced, and gave Mr. Lyda the confidence he needed to decide on a final bid amount. Performed quantitative take-offs, priced labor, prepared general conditions based on an initial project schedule, determined time to complete, estimated equipment needed (cranes, earth moving, etc.), prepared the final bid package, prepared all tabulation sheets, conferred with subcontractors, architects, and engineers.

Achievements:

I was originally invited by Mr. Gerald Lyda and Mr. Calvin Renfro to participate in the value engineering of a theme park known then as Fiesta Texas (Six Flags Fiesta Texas today), a venture owned by Opryland and USAA. Lyda joint ventured with Manhattan Construction (Houston office) for the General Contract while the design architects, a Canadian consortium named Forrec, contracted a San Antonio architectural consortium for supervision and residency. As much as these associations crippled our efforts to meet the owner’s budget, we were in the end successful. Fiesta Texas stands. I stayed with Lyda until 1998 and enjoyed exciting and challenging projects with them. Among them the Alamodome, the Hyatt Hill Country Resort, the Large Blast

& Thermal Simulator, and others. My obligation was to Mr. Lyda who decided to retire in 1997 and sold Lyda, Inc. to Swinerton, Inc. in 2003. In 1998 I decided to enter college.

GENERAL INFORMATION

I am a constructor and academician who was raised in construction and ranching, with above average talents in Estimating, Project Management, and Compliance. I was born to work and produce.

I have participated in pre-construction estimating, negotiations with owners, final estimating, subcontracting, purchasing, cost control, project management, and punch-outs in projects of a magnitude of up to $800,000,000.00 USD.

Estimating reaches beyond calculations. The estimator is the first individual that comes across complexities, anomalies, ambiguities, or contradictions in the plans and specs. The estimator is also the first to draw a progress schedule draft and required time to complete. Team cooperation begins at this point and the solutions agreed to should be carried through via proper and timely written communications.

Proper maintenance of construction scheduling, monitoring cash flows and expected cash flows, ensuring dependencies are met, beating milestones, and continued collaboration with the project’s associates are vital for a project’s successful completion and a satisfied customer. An amiable and trusting environment is a must. Having been familiar with Microsoft Windows, Lotus Suite, Symphony, MC2, BidTek, digitizers, Autocad, SketchUp, and Primavera I can easily adapt to any application, whether for estimating, management, cost control, or design. I am aware of programs such as VDC, BIM, Procore, and others which I would have ease to learn. Negotiated contract types (Build Design, GMP, IPD, RFPs, cost plus, etc.) demand a trusting and open relationship between O/A/E and Contractor. These require an estimate that can easily adjust to changes as they arise. Value engineering is vital. Hard bid contracting requires excellent relations with subcontractors and suppliers. I am familiar with the Metric System, the Imperial System, Roman numerals, and inequality math. I can easily convert from Imperial to Metric and v.v. I have had the pleasure of working with cattle, an enterprise I owned for 39 years and ceased operations March 16, 2022. It required lifting 50# feed bags amid 2,000# animals. This requires an acute alertness of immediate surroundings and an understanding of nature. I am the Trustee for my Family's Trust. This has trained me in global financial patterns and taught me how to evaluate the true financial condition of an enterprise and its trends. It (the Trust) works well on its own.

I speak, read, and write fluent and impeccable Spanish. I understand the Spanish idioms of all Latin America including the Antilles Islands. I communicate well with and am familiar with all their differing cultures. I participated with the Olympic Committee of the Summer Olympic Games in Mexico City in 1968 and experienced first-hand the Soccer World Cup in 1970. This exposed me to the world's peoples and their cultures. All my children are grown and on their own and am free of debt except for a student loan. This allows me the freedom to work anywhere I am needed and be able to focus on work without the interference of external preoccupations.
