Representation Agreement
SERVICE Description USCIS/EOIR/OTHER FEES AND COSTS
SERVICES TO BE PERFORMED: CSS/ILS agrees to perform the following service(s) on behalf of Client(s): THIS AGREEMENT for legal services is made between Catholic Social Services/Immigration Legal Services (“CSS/ILS”) and Client(s): CSS/ILS RESPONSIBILITIES:
1. To provide such legal services as reasonably may be required to represent Client(s) in reference to the above described services. 2. To provide representation in a professional manner and to maintain communication with Client(s) during the pendency of the case and to and consult with Client(s) before any significant decision is made on Client’s behalf. 3. CSS/ILS can undertake the representation of both an applicant for benefits and the sponsor in family and/or employment based cases, as long as the parties in such representation have mutually aligned interests. CLIENT RESPONSIBILITIES:
1. To attend all scheduled appointments or to call at least twenty-four (24) hours before an appointment to reschedule. Otherwise, Client(s) will be charged for the missed appointment.
2. To truthfully provide all information regarding Client(s) background information and Immigration history, to provide all requested documentation promptly and to fully cooperate in the preparation of their case. 3. To promptly respond to communications from CSS/ILS and to immediately notify CSS/ILS of any notices Client(s) received from the USCIS, the EOIR or any other agency.
4. To attend all court hearings, interviews or other appointments scheduled by the USCIS, EOIR or the Department of State or any other agency as required by my case.
5. To keep CSS/ILS updated as to all developments, including but not limited to all changes of name, address, telephone number, email address, immigration status, arrests and other relevant information. 6. I understand that I am required to report any changes in my address and/or telephone number to the USCIS within ten (10) days or the EOIR within five (5) working days of making such change. Therefore I will contact CSS/ILS in advance of any move to ensure timely notice is provided.
TERMINATION OF REPRESENTATION:
1. Client can terminate representation of CSS/ILS at any time by written notice [subject to Court Approval, if required]. a. Client(s) will be provided a full copy of his/her file upon request. b. Client(s) will be charged $.15 per page and will be required to the pick up the file from the office and sign a release. c. All outstanding fees and costs must be paid before the file will be released. 2. CSS/ILS reserves the right to terminate service and withdraw representation if: a. CSS/ILS believes the client is not being truthful, has misrepresented the facts or discovers Client(s) has provided false information in connection with the case.
b. Client(s) fails to fulfill his/her responsibilities as set forth above. c. Client(s) fails to pay as agreed herein.
d. A conflict arises between the parties.
In the event CSS/ILS terminates USCIS representation, CSS/ILS will notify the USCIS or any other agency and send a copy of said correspondence to Client(s).
In the event CSS/ILS terminates EOIR representation, Client(s) will be sent a copy of the Motion filed with Court, requesting permission to withdraw representation.
FEE: I understand that the following fees, plus costs are non-refundable, and must be paid in advance of submission of documents and/or representation.
In the event of error by the United States Citizenship and Immigration Services (USCIS) which necessitates filing or refiling a new application on your behalf, additional legal fees will be required. In the event Client(s) requests or needs any additional services, a new fee agreement will be prepared. COSTS AND EXPENSES: In addition to fees for legal services, you will be responsible for certain costs and expenses that are incurred in connection with your representation. These costs can include charges for such items as toll telephone charges, photocopies, postage, travel expenses, court costs, filing costs, etc.
NO GUARANTEES: The Client(s) understands that CSS/ILS cannot and does not warrant, guarantee or predict results or the final outcome of the case. ACKNOWLEDGEMENT AND COPY: Client(s) has read and understands this document (or has had someone translate this document). The Client(s) understands that the signing of this agreement indicates an understanding of the terms and responsibilities set forth in the agreement. Client(s) acknowledges receipt of a copy of this Agreement.
