WORK EXPERIENCE U.S. BORDER PATROL 4/1991-Present

NOGALES STATION USA Grade Level: GS13

Border Patrol Agent/ Senior Patrol Agent 04/01/1991-Present

On April 01, 1991 I began my tenure as a Border Patrol Agent in the El Paso, Texas Station. While in the performance of my duties as a Border Patrol Agent I have performed Freight Train Check, Checkpoint, Line watch Duties, Airport Duties and I have worked with various Local, Federal and State agencies to enforce local federal and state laws. I examine documents and interview person's claiming to be United States Citizens, I interview these people to determine their true citizenship and identities. I administer oaths, take sworn statements, and arrest violators of the Immigration Laws of the United States. I prepare arrest reports to ensure that the appropriate administrative and criminal charges are applied. I seize for forfeiture any conveyances used to smuggle undocumented persons or narcotics, and present all evidence for successful prosecution. I was detailed to the El Paso Sector Horse Patrol Unit for the period of one year; however I was extended for an additional six months to assist in the implementation of Operation Hold the Line. While detailed to U.S. Marshal Fugitive Task Force I gained valuable experience working with various Law enforcement Agencies. My duties involved many hours of investigation and surveillance to bring wanted persons into custody for Local State and Federal violations of the law. I had the opportunity to be detailed to the Brownfield Station in southern California for the period of thirty days during the initial implementation of Operation Gatekeeper. On September 13, 2001, I was detailed to Logan International Airport for a thirty day period as part of a security force to ensure the safety of the traveling public after the World Trade Center Bombings of September 11th. I was sworn in as a U.S. Marshal for this thirty day period and received letters of commendation from both the Chief U.S. Marshal and the Chief of the United States Border Patrol in Washington DC. I am also a certified Firearms Instructor, and I have been detailed to Artesia, NM and Charleston, SC as a firearms instructor for new Trainee Agents as well as Senior and Journeyman Border Patrol classes. I am currently part of the El Paso Sector National Recruitment team; which received a group Commissioners Award in October of 2000. Some of my other collateral duties include FLIR camera operator and ATV instructor and team member. As an ATV instructor I had the opportunity to train the first group of ATV instructors for the Ciudad Juarez, Chihuahua, Mexico Police Department. These new instructors were able to return to Ciudad Juarez, Chihuahua Mexico in order to start and implement the new skills learned and begin a new and safer ATV program for their own Police Department. I have been detailed to the El Paso Station Bike Patrol Unit on several occasions, these assignments have allowed me to have close contact with the general public in and around the Downtown El Paso area and to develop informants with relevant information regarding alien and narcotics smuggling. I have been assigned to the El Paso Station Sensor Implant Unit for the period of a year. I was selected to join the El Paso Sector Evidence Team and I have successfully completed the required eighty hour training course to become a member of this unit.

Supervisory Border Patrol Agent 05/27/2007- Present

On May 27, 2007, I was promoted to the position of Supervisory Border Patrol Agent at the Fabens Texas Border Patrol Station.

As a Supervisory Border Patrol Agent I am responsible for the execution of all station functions and operations. I direct activities aimed at preventing the illegal entry of aliens into the United States by land, water, or air; seeking out and apprehending aliens who are illegally in the United States; apprehending smugglers or aliens; and enforcing the criminal provisions of the Immigration and Nationality laws. Additionally, I am responsible for all normal functions involved in supervising personnel, including the approval of leave, resolving disciplinary problems, and preparing annual performance appraisals. I regularly perform duties as an Acting Filed Operations Supervisor in his/her absence.

I work closely with other federal, state and local law enforcement officials on both sides of the border to identify, locate and/or apprehend aliens; prepare, present and defend deportation or exclusion proceedings; and ensure the physical removal of aliens from the United States. This work involves working with both criminal and/or non-criminal aliens in the United Sates at various stages of their apprehension and detention proceedings. Additionally, I am responsible for conducting complex investigations; conducting surveillance work; preparing investigative reports; and assisting in complex, difficult, or sensitive seizures.

I liaison and interface with U.S. Customs Office of Enforcement Special Agents, Customs Inspectors, and Immigration Inspectors on a daily basis, and establishes and maintains contact with all area federal, state, and local law enforcement agencies to develop intelligence relevant to smuggling in and around area ports of entry. I conduct debriefings and interviews of both alien and narcotics smugglers. These interviews and debriefings help us to establish post seizure analysis reports and real time smuggling intelligence activity.

As a Supervisory Border Patrol Agent, I conduct a thorough review of all case files generated during my tour of duty. I interpret and apply law, policies, and procedures to insure that interrogations and interviews are conducted properly and yield admissible statements and information. I resolve complex technical questions related to the status of aliens during smuggling, fraud, and false claim to citizenship or other status using sound judgment and knowledge of law, precedent decisions, and Service policies and procedures. This review does at times encompass legal research to support prosecution guidelines on criminal and administrative cases. I assess the facts and relevant laws in particular cases to determine that violations exist. This review and research assists U.S. attorneys in representing the Government in court actions. I testify in court about my actions and decisions, employing my knowledge of court procedures and policies to enhance effectiveness of my testimony.

Being promoted to supervisor at a station with 300 plus agents exposed me to a wide range of agents ranging from the trainee to the twenty-year plus veteran. This exposure proved to be invaluable when dealing with subordinates under my supervision, by de-escalating situations between management and subordinates, when possible, as well as motivating and guiding agents to perform their duties in order to accomplish the Border Patrol mission.

During my 24 years with the U.S. Border Patrol, I have learned the value of developing and maintaining sources of information from all sectors of the community on both sides of the United States and Mexican borders. I have a good working relationship with people from all levels of business, the public sector and with people from various socio-economic backgrounds. I stay active in my local community, church and school affairs in order to meet more people and to let them develop a trust in law enforcement personnel.

During FY 2009, I was detailed to the Fabens Station All Terrain Vehicle Unit. This unit consists of eight Border Patrol Agents that rotate through the unit on a quarterly basis, and two sensor tech Agents that are assigned on a yearly basis. As the unit supervisor, my duties included scheduling of the agents assigned to this unit on a daily basis as well as the scheduling of a variety of public affairs obligations that are intended to educate students in the local community as well as the public. Other responsibilities include the scheduling of both basic and instructor ATV certification classes for the Agents of the Fabens Station as well as the Ysleta and El Paso Border Patrol Stations.
