Report to the Director of Central Operations, the Manager of Central Programs is the senior manager of the program arm (non-Quality Assurance) of the Central Operations Department. The Manager of Central Programs serves as the U.S. Department of Labor’s agent responsible for the day to day management, administration and proper provision of program services of some of the Division of Career Services’ highest volume programs, including the Alien Labor Certification (ALC) Program, Trade Adjustment Assistance Programs (Trade), and the Worker Opportunity Tax Credit and Welfare to Work (WOTC/WTW) Programs. .

1. Alien Labor Certification Program –

As the U.S. Department of increased imports or transfer of ALC applications and Prevailing Wage surveys (PW) under Section 212(a)(14) of the Immigration and Nationality Act (INA) allowing that certain aliens may obtain a visa for entrance into the US in order to engage in permanent/temporary employment if the Secretary of Labor has first certified (via DCS application approval);

Manage both ALC application processing and the DCS provision of PW surveys under the Immigration and Nationality Act (INA) as amended by the Immigration Reform and Control Act of 1986 which provides a means for agricultural employers to apply for permission to bring into the US nonimmigrant aliens to perform agricultural labor or services of a temporary or seasonal nature to ensure compliance with governing Federal and State laws, rules, regulations, guidelines and standards;

Insure Prevailing Wage’s are processed accordance with the Federal standards pertaining to Occupational Employment Statistics, and U.S. Bureau of Labor Statistics;

Maintain liaison and provide problem resolution with the U.S. Department of Labor (DOL) Regional Office staff, attorneys and employers as well as various DCS field managers and staff; oversee staff responsible for providing technical assistance in ALC applications / PW surveys, administration of the job order database,

Maintenance of federally mandated records retention for ALC candidates resumes, employer/agency correspondence, and DCS ALC-findings documentation

2 Trade Program –

Manager of Central Programs is responsible for the oversight and management of TAA (Trade) programs including providing staff with training and development on Federal Trade regulations, eligibility requirements, and benefits administration the development and preparation of the annual Trade budget; direct the Trade quarterly program and fiscal reporting submissions in accordance with US DOL requirements.

Review and approve funding/training requests, establish program operating policies, procedures relative to eligibility requirements, training programs, travel reimbursements; work with DCS Rapid Response team.

Career Center staff and employers on obtaining trade certified status for business to allow dislocated workers to obtain Trade benefits.

3. Worker Opportunity Tax Credit & Welfare to Work Tax Credit Programs –

The WOTC provides an employer with a tax credit for each new hire that falls within the specified targeted groups identified within WOTC regulations.

The WTW Tax Credit provides employers with a credit for each new hire that is a member of a family that has received Temporary Assistance for Dependent Children (TAFDC) for at least 18 consecutive months ending on the date of hire.

The Manager of Central Programs monitors the administration of WOTC/WTW, including review and analysis of program data to determine program effectiveness and utilization by employers, coordinating activities with the Federal Internal Revenue Services (IRS), USDOL, MA Dept of Revenue, and One Stop Career Centers to exchange information and resolve problems relating to WOTC/WTW.

Manages the provision of technical assistance and training to DCS managers and staff, employers, attorneys, agents, and state and federal agency personnel (including MA Dept of Corrections, MA Dept of Transitional Assistance, MA Dept of Mental Health, MA Rehabilitation Commission, and the Federal Social Security Administration);

Directs program training and marketing to employees and employers on the program requirements and evaluates the administration of WOTC/WTW application monitoring, program reporting, customer assistance/responses and other WOTC/WTW functions.

4. Contracts

Collaborate with the DCS/DUA Finance Unit to ensure the timely and accurate administration and processing of contracts, agreements, and modifications pertaining to Central Programs financial matters. Includes quality control, assessment, and implementation of contracts, agreements, modification, payments, and transfers or disbursements in partnership with Finance’s Accounts Payable and Contracting and Procurement Units.

5. Special Projects –

As requested by the Director of Central Operations, participate in special projects, including but not limited to partnering with the DCS Central Operations Quality Assurance Unit or the DCS/DUA Internal Control and Workplace Safety Department to facilitate state and federal audits;

Aid in business process design, development and testing of the Trade Adjustment/Rapid Response/National Emergency Grant (TAARRNEG) system enhancement to the Massachusetts One Stop Employment System (MOSES), including the review, assessment and recommendations to changing TAARRNEG functionality in MOSES, based upon operational requirements.

6. Other duties, as assigned

In addition, the functions of the Central Programs Manager is to constantly monitored, ensure that effective, efficient and accurate technical reviews occur and corrective action and strategies are rapidly applied where necessary in the face of the seemingly constant change in federal processing guidelines, requirements, and funding (such as Alien Labor Certification).

Lastly, providing timely responses to a large number of on-going federal compliance reviews and employer queries is an on-going challenge.

WORKING RELATIONSHIPS

• US DOL Regional Office Managers/Staff – respond to inquiries, provide information, seek program assistance/guidance where needed.

• Managers and staff of the USDOL Occupational Employment Statistics (OES) / Bureau of Labor Statistics (BLS) Units – respond to inquiries, obtain information, and provide assistance as necessary.

• Work with Attorneys, Employers, and Agents for ALC, PW, and WOTC/WTW as issues arise.

• Serve as a resource to Employers Seeking WOTC/WTW tax credit approvals

• Support DCS Field Operations managers and staff – provide technical assistance, information, and guidance on Central Programs.

• Support DCS Central Operations staff – including coordinating prevailing wage survey requests for H-1B ALC agricultural program customers

• Respond to inquires from managers and staff of the Massachusetts Division of Unemployment Assistance as necessary on Trade Training issues.

• Respond from inquires from the Massachusetts Department of Workforce Development as needed.

QUALIFICATIONS

A. Knowledge, Skills and Abilities

• Understanding of the principles of management and staff supervision.

• Knowledge of budget and finance/taxation principles.

• Ability to manage staff including assigning and evaluating work product, employee performance, and fiscal.

• Knowledge of continuous quality improvement techniques.

• Understanding of data collection and wage/salary survey methodology.

• Ability to understand, interprets, explain and apply relevant Federal and State laws, rules, regulations, policies, and procedures.

• Ability to analyze and determine the applicability of data to draw conclusions and make recommendations on federal programs to determine certification/eligibility.

• Familiarity with US Immigration and Naturalization laws, rules, regulations, policies and procedures and North American Free Trade Act (NAFTA) certification processes.

• Familiarity with the Federal Standards Contract Act (SCA) and Davis-Bacon Act.

• Knowledge of the Dictionary of Occupational Titles (DOT)

• Knowledge and experience in collecting wage surveys/data.

• Knowledge of the principals of economics.

• Knowledge of and the ability to understand, explain, interpret and apply Federal standards pertaining to Occupational Employment Statistics, and U.S. Bureau of Labor Statistics Prevailing Wage surveys.

• Knowledge of, and ability to understand, explain, interpret, and apply Federal and State Laws rules regulations, policy and procedures governing the Trade program.
