Pranami Patel “ Legality of Euthanasia” INDIAN JOURNAL OF INTERNATIONAL LAW, November 2020 INDIAN JOURNAL OF INTERNATIONAL LAW: Legality of Euthanasia November 15, 2020 A 30 page thorough research paper on the legality of Euthanasia. Research was performed under the guidance of Dr. H.K. Nagraja, professor at National Law School of India University. The research paper is being published in the INDIAN JOURNAL OF INTERNATIONAL LAW. The goal of the research paper was to present arguments for and against the claim that there is a moral distinction and the use of active and passive euthanasia. Next, I examined the cases which resulted in the acceptance or rejection of the idea of active or passive euthanasia. Specifically, I did a case study on the supreme court cases, Glucksberg v. Washington and Quill v. Vacco. The case study provided a brief for readers to see why certain states think it’s appropriate to consider the practice of euthanasia legal. The states that legalized the practice of euthanasia show readers that euthanasia should be protected by legislation because it honors the dignity and free will of a patient. My research showed that the motives or intention of performing euthanasia plays an essential role in determining the rightness of an action. However, it is notable that euthanasia (active and passive) should be allowed when it results in the most outstanding overall utility. Euthanasia in the case of a terminal patient who is unbearably and hopeless suffering should be allowed as it leads to the greatest good. It helps in alleviating the patient’s suffering and also the burden of the loved ones.
