I am sending this letter, along with my attached resume, transcript, writing sample, to express my interest in applying to an office at the Federal Communications Commission as a legal intern this summer. As a Tech Law Scholar and former litigation paralegal, I welcome the opportunity to apply and refine my general legal research and writing skills as well as a deeper understanding of information privacy policy and algorithmic bias. The expertise that I can bring to the office next year is well-suited to the tasks laid out before the interns.
During my undergrad I interned in Congressman Gene Green’s office which sparked my fascination with digital communication technologies. After undergrad, I worked in legal technology, building on this interest before applying to law school. Last summer, my time, not only as a GU Tech & Society Fritz Fellow but as a Research Assistant at Georgetown’s Institute for Technology Law & Policy, deepened my interest in legal theories around machine learning governance tools as well as interdisciplinary considerations about cyber law and policy. I will make certain that I only further enrich the program by doing all I can to add to the collective resources and proudly represent the Georgetown Law student body. Division M - Telecommunications Provision
Summary
The Title II E-Rate Support provision requires the FCC to promulgate regulations making connected equipment at public schools and libraries, such as modems and routers, available to students, teachers and patrons who may not have reliable advanced telecommunications access in their own homes. This provision applies to Tribal elementary and secondary schools as well as Tribal libraries who will be entitled to no less than five percent (5%) of the funds made available to the FCC. The Title III Emergency Benefit for Broadband Services provision stipulates that internet service providers (ISPs) will provide eligible households with a service offering equal to the emergency broadband benefit available to them upon the request of a member of the household. Eligibility for the benefit is determined through the National Lifeline Eligibility Verifier or an FCC approved verification method conducted by an ISP. Providers will be reimbursed for the service and hardware provided, such as
“connected devices” by the FCC using the Emergency Broadband Connectivity Fund. This reimbursement will be issued pending a mandatory certification process. However, there will be no reimbursement for services rendered and hardware supplied before the act is enacted. This provision also provides for enhanced minimum standards for federal Lifeline benefits during emergency periods. Lifeline beneficiaries shall be eligible for unlimited minutes and uncapped data from the beginning of the emergency period to six months after the date, unless extended. The Title IV Continued Connectivity provision makes it illegal for telecommunications and voice service providers to shut off a household’s service or impose late fees in response to unpaid bills through the emergency period. It will also be illegal for providers to impose data caps or charge for additional data usage during the course of the emergency period. Denial of internet or telecommunications services to eligible households shall be treated as a violation of the Communications Act of 1934. Figures
The HEROES Act so far provides $3 trillion to healthcare infrastructure and the economy. The bill specifically dedicates $5.5 billion to “closing the digital divide” with $1.5 billion earmarked immediately for the FCC’s E-Rate Program, which provides schools and public libraries with internet
“hot spots” and “connected devices”. The remaining $4 billion ($8.8 billion through fiscal year 2021) is earmarked to immediately establish the Emergency Broadband Connectivity Fund, a resource pool for ISPs and telecommunications services to provide $50/month subsidies to low income families and furloughed workers, ensuring continued connectivity. Eligible households on Tribal land are entitled to discounts of $75/month. The bill authorizes $200,000,000 in state grants through fiscal year 2020 available through fiscal year 2021 to strengthen the National Lifeline Eligibility Verifier. Projected Timeline & Expected Changes
The bill was debated and passed in the House by the Appropriations, Budget and Ways and Means Committees. It will likely be debated in the Senate Finance Committee.
Implementation and enforcement of regulations governing expanded E-Rate support and the establishment of the Emergency Connectivity Fund is left to the FCC no more than 7 days after its passage into law.
The FCC shall expedite ISP access to the National Lifeline Eligibility Verifier and ensure that eligible households receive their broadband benefit no later than two days after the submission of required information.
The FCC will certify to the House Energy and Commerce Committee and the Senate Commerce, Science and Transportation Committee that the necessary state grants have been disbursed no later than 21 days after the act’s passage into law.
The Emergency Broadband Connectivity Fund is to be made available until September 30, 2021. Dem & Rep. Leadership
In a joint statement Democratic Representatives Frank Pallone of New Jersey and Mike Doyle of Pennsylvania expressed an increased need for reliable connectivity in the age of COVID-19 saying, “With schools closed and millions out of work, Congress must use its powers to keep Americans connected. They also expressed an optimistic view of its passage in the statement saying, “We’re hopeful that this legislation will garner strong, bipartisan support so we can stand up for children and families who are struggling during this pandemic.” Democratic legislators are optimistic that the provisions of the bill including financial relief for state and local governments will be enough to swing some Republicans to support. However, all eleven of the House cosponsors were members of the Democratic Party, and the bill was passed along strict party lines with only one Republican rep. voting in its favor and 184 voting against it. House Minority Leader Kevin McCarthy called the bill “a waste of taxpayer time” in a tweet and declared that there was no chance of it being signed into law. Nonetheless, the bill is headed to the Republican dominated Senate to face further scrutiny. Senate Majority Leader Mitch McConnell (R-KY), has already expressed opposition to an emergency broadband provision as part of any potential stimulus packages claiming that such infrastructure is
“unrelated to the coronavirus pandemic”. Predictably he has an unfavorable view of this latest stimulus package, referring to it in comments made to the press on May 19th as a “parade of absurdities” and a “far left wish list”. This sentiment is not only held by the Majority Leader as Sen. John Cornyn of Texas commented specifically on the bill as well, referring to it as “more of a political statement”. The Biden campaign, despite pressure in the form of a 250,000 signature petition to endorse a more robust monthly stimulus has yet to comment on the bill and is unlikely to do so in the near future. The Biden campaign has been keeping the lines of communication with the Democratic leadership in the House and Senate open according aides and sources. However, there seems to be an understanding between all parties that Biden’s involvement in remedial legislation may do more to hinder negotiations than help. The Democratic Presidential Nominee has not released a statement regarding the HEROES Act or its Emergency Broadband Service provision.
Division I - Small Business Provision
Summary
Amendments to the Paycheck Protection Program extend it through December 31, 2020. Section
(e) extends “small business” status to certain local news media. For local news media to qualify as a small business, the individual physical location at the time of loan disbursal cannot exceed the size standard established by its North American Industry Classification System code (beginning with 511110, 515112 or 515120). Local broadcast stations will be eligible for small business loans provided directly to the physical location of the business if adequate need is demonstrated.
