Appellate Experience

Represented and/or counseled clients in appellate matters pending before the Superior Court of Pennsylvania on the interpretation of commercial contractual language, the enforcement of ambiguous terms in property settlement agreements, and on issues of bifurcation in divorce, custody procedure, and support procedure. Represented clients in appeals before the Commonwealth Court of Pennsylvania for zoning, Right to Know Law, DHS appeals and the constitutionality of the child protection act as applied. Most recently, successfully represented the Appellant in the published decision of Dumas v. Brooks, 2018 Super. Ct. 357 (Pa. Super. Ct. Dec. 31, 2018) where the Superior Court found the lower court lacked jurisdiction to enter a reconsidered decision under Pa.R.C.P. 1030.2. The Superior Court vacated the reconsidered decision and reinstated the previous support order. Reported Appellate Decisions

Dumas v. Brooks, 2018 Super. Ct. 357 (Pa. Super. Ct. Dec. 31, 2018) (in favor of client, lower court's reconsidered decision vacated and previous support order reinstated for lack of subject matter jurisdiction). Scott v. City of Philadelphia, Zoning Bd. of Adjustment, 88 A.3d 1071 (Pa. Commw. Ct. 2014) (in favor of client, Commonwealth Court reversed lower court and held that Appellant had rightly asserted standing before the ZBA).

Scott v. Delaware Valley Regional Planning Commission, 56 A.3d 40 (Pa. Commw. Ct. 2012)(Office of Open Records does not have jurisdiction over DVRPC).

Montgomery County v. Iverson, 50 A. 3d 281 (Pa. Commw. Ct. 2012)(impact of search request is a factor in whether request can be considered sufficiently specific). Scott v. SEPTA, July Term 2011, No. 1600 (Phila. Com. P1. Aug. 3, 2012)(in favor of client, metadata deemed discoverable under the RTKL).

Domestic Relations Experience

Counsel in hundreds of domestic relations cases in Pennsylvania over the past 10 years. Represented members of Philadelphia Fraternal Order of Police, Lodge 5, as part of their members legal services plan since 2010, up and through the present day. Extensive experience representing clients in domestic relations cases in Bucks, Montgomery, Chester, Delaware, and Philadelphia counties. Trial experience on numerous issues of equitable distribution, custody, child support, spousal support/APL, Protection From Abuse (PFA), contempt, and some juvenile, adoption and dependency matters. Extensive experience representing clients in New Jersey counties as well. General Civil Litigation Experience

General Counsel Experience

Represented client in numerous cases involving defense of ‘“as is” sales, warranty sales, service contract sales issues, allegations of NJ consumer protection act violations, etc. Advised client on policies for prevention of same. Advised client on viability of restrictive covenant in employment contract re: scope, length and territory, and provided policy advise for general protection of customer information/good will. Advised client of relevant employment discrimination standards and developed usable and practical workplace policy. Advised on hostile work environment discrimination standards. Litigated case for client in NJ tax court against director of division of taxation in tax assessment dispute. Represented client against local municipality for alleged ordinance violations, licensing issues, and land use development/zoning issues. Represented client in claims against client’s insurance company for property/casualty/theft loss. Advised on miscellaneous corporate governance issues.

Plaintiff’s Counsel Experience

Prosecuted slip and falls on commercial property, private residential property, and on government property involving the Tort Claims Act. Prosecuted full tort automobile major jury cases in Philadelphia county. Prosecuted several contract/ denial of claims against insurance companies for general breach and alleged bad faith. Defense Counsel Experience

Defended uninsured property owner in slip and fall in Philadelphia County involving secondary liability. Defended pizza parlor owner/principal in construction/contract dispute with general contractor. Administrative Agency Experience

Extensive litigation involving the Pa Right to Know Law and NJ Open Records Act. Utilized RTKL and OPRA on behalf of clients to obtain records and obtain other goals. Represented politician/objector in numerous zoning appeals in Fishtown area, Philadelphia community before the Philadelphia zoning board of adjustment. Represented clients in DHS hearings and appeals.
