OVERVIEW

I am currently retired since September, 2013. I was Director of Toxicology/Medical Monitor at Synergy Laboratories in Las Vegas, Nevada since January 2010 until retirement. I still continue to contract out as a toxicology expert for physicians setting up pain management testing, performing medical monitoring and for attorneys needing a Forensic Toxicologist Expert in legal matters. Since retirement, I have assisted in setting up pain management testing and then perform medical monitoring for physicians in New Mexico, California and I was retained by the Las Cruces, NM District Attorney’s office in a homicide case they were prosecuting plus being retained on a large number of cases in Las Vegas. In the past, I founded and was Director of American Toxicology Institute Inc., a Las Vegas drug testing laboratory with emphasis on education and research in forensic and clinical toxicology. I have been qualified as a forensic expert in many jurisdictions for over 35 years. I have given numerous seminars, workshops, lectures, and certifying classes in forensic toxicology and chemistry in Nevada for University Continuing Education, Nevada Bar, Law Enforcement, Corrections, other local, state, and federal agencies, School Districts, Counseling, private employers, parents, students, labor unions, physicians, nurses, medical laboratories, judges, arbitrators, and military. I personally performed toxicological testing in the deaths of Elvis Presley, Sonny Liston, Howard Hughes and Teddy Binion all in Las Vegas.

EDUCATION

University of Nevada, Las Vegas (UNLV) Graduate School, 1987-1994 GPA 4.00. Completed all requirements for Master of Science degree in Post Secondary Education, taking more classes than needed. However, the thesis requirement was not completed to meet the requisite time for the degree. After coming to realize from unexpected delays from the Clark County School District that I would not be able to finish in time, I decided to continue anyway and complete my thesis which consisted of conducting surveys of the success and effectiveness of DARE (Drug Abuse Resistance Education) in two Clark County Nevada high schools, which I completed in the fall of 1994 about a year beyond curriculum requirements to be awarded a MS degree. While in graduate school in the College of Education, I was a member of Phi Kappa Phi representing an academic standing in the top 2% of the graduate class, which I held for six years. As adjunct member in the College of Health Sciences, I taught drug testing methods and interpretation to students on and off campus using my own laboratory as a teaching site which received accreditation by the board of Education as an off campus teaching laboratory facility. Professor Art Meyers, responsible for assigning students to off campus teaching facilities related to me that I had received the highest student evaluation he had ever recorded to date among facility teachers. Teaching has been a favorite pursuit of mine. The ability to explain scientific things has helped me I believe as an expert witness as well.

Special Achievements: One of two students selected by the Chemistry Department to conduct research on an organic synthesis project funded by a federal grant. Directed by Dr. Robert Smith, Dean of UNLV ‘s Chemistry Department. The research continued for two years involving comprehensive research and documentation to support eventual published findings. I received my own office and laboratory space, very unique for an undergraduate student at the time. Extensive use of instrumentation and quality control with emphasis on methods development and innovative approaches to testing was required.

I received four years of formal training in toxicology by the late Dr. Thorne Butler, a Board Certified Forensic Toxicologist and Pathologist. Originally hired by Dr. Butler as his research assistant, then phased into the requisitioned testing of the laboratory because of needs that arose. I testify and consult as an expert for both defense and prosecution.

I teach by seminar, lectures, workshops or consulting - judges, attorneys, arbitrators, hearing officers, referees, case workers, administrators and others including general drug testing education in specific cases that may be adjudicating at the time. My expertise in chemistry and toxicology include laboratory certification; drug and alcohol testing policies; laboratory testing methods, procedures and quality control; instrument operation, maintenance and analytical data evaluation; metabolism, elimination, dosage, clinical effects, and impairment of drugs and alcohol; collection, accessioning, handling, chain-of-custody, storage, and stability of specimens; medical review, interpretation, and reporting of results. I have been qualified as a forensic chemist and forensic toxicologist in District, Justice, and Municipal Courts in Nevada, Utah, Arizona, New Mexico and California. I have testified in labor arbitrations in a number of states; in Federal Court; in military court for the U.S. Army, Navy, and Air Force; and by the National Park Service, BLM, Fish and Game, the U.S. Department of Treasury, and other State and Local Government Agencies. I have been approved by the Drug Enforcement Administration to retest samples initially tested by federal laboratories upon request by the Federal Public Defender. I routinely test or retest samples submitted by law enforcement agencies for drug and alcohol related arrests. I have been qualified as an expert in hair testing in the District Courts of Nevada. I have been contracted by the State of Nevada as an expert for the Nevada Highway Patrol, the Department of Parole and Probation, the State Industrial Insurance System (SIIS), and the Nevada Attorney for Injured Worker’s (NAIW) for interpreting blood, urine and hair drug and alcohol testing used to determine DUI cases, parole or probation violations, arbitrate workman’s compensation, or adjudicate child custody in Family Court proceedings.

RESEARCHER

I developed testing methods utilized by University Medical Center, particularly for alcohol/drug testing in blood samples to provide faster, more accurate and more cost effective testing; developed numerous methods for improved environmental and chemical testing at Western Technology Corporation and Atlas Chemical Testing Laboratory. Much of the testing was unique and designed specifically for the sought for results. As an example, when self lighting charcoal briquettes came out, I was asked by a developing company to prove analytically which of four prototypes of charcoal produced the most heat over the longest period of time. I designed a special closed insulated system to determine this information, which I never used again. I authored the instructions for using the first self-lighting briquettes, which appeared on packages of the superior prototype. In another research project at ATI, I developed a blood testing method for drugs that is substantially quicker to perform and is just as, if not more, accurate than existing methods, which continues to be used today. Also, in the early 90’s at ATI, I developed a hair testing methodology for drugs of abuse which, like in the other cases, I researched and developed alone, taking me a year and a half to develop. This hair test has now generated over a million tests for ATI nationwide. Before introducing the hair test into the workplace, however, I tested its legal prowess in the court system for a year and a half without incident. Today, local courts continue to use this hair test almost exclusively in adjudicating child custody cases. This type of testing that takes children away from their parents must be extremely accurate, which was my aim in its development. In the tens of thousands of hair tests performed by the courts since its introduction, not one to date has been successfully legally challenged.

I oversaw all drug testing conducted by Synergy Laboratories as well provide expert testimony as needed.

Police chief called me in June, 2006 asking me if I could do their blood alcohol testing for traffic DUI’s, as Metro crime lab was so backed up they could not get out results in a timely matter. I agreed beginning in July, 2006. The number of BAC’s I have performed for them has been between 30 & 50 per month, making the total to date approximately 1500. Additionally, in February, 2009, the same request for the same reasons came to me from the Narcotics Bureau to perform contraband testing. I agreed and the testing has been ongoing since that time. I first had to design a secure location to perform the testing accompanied by adequate procedures and reporting methods. This was done on ATI premises with access allowed only to me. To June, 2009 I have conducted testing on 200 cases involving amounts of methamphetamine, cocaine, heroin, cannabis, and prescription pills.

Metro Police Crime Lab

Identification or “ID” Officer. Investigated crime scenes such as burglaries, robberies, shooting, rape, accidents, and homicides for retrieval of evidence. Performed specialty photography, fingerprint recovery and comparisons, gun powder residue detection, comparison microscopy, drug detection, documentation, mapping, and numerous other crime scene duties as they were needed. Court testimony was routine.

State Trooper. Graduated from Nevada Highway Patrol Academy (12 weeks)

Received Certificates of Achievements in accident investigation, civil defense, drug enforcement, firearms, riot control, self defense, crime scene investigation, and others. As a state trooper, I patrolled the highways of Nevada enforcing Nevada laws, investigating motor vehicle accidents, assisting motorists, issuing citations, making arrests, confiscating stolen property, illegal weapons, and controlled substances, observing and documenting impairment effects and characteristics associated with the use of various types of controlled substances and alcohol. Special assignment in addition to police duties was to maintain gas chromatograph for breath testing, and to train other officers in its use.

Chemist/Toxicologist in laboratory, Performed chemistry and toxicology analysis under the direction and training of Dr. Thorne Butler, and was involved in considerable research and development of new methods of analysis, evaluating testing systems, establishing protocols for surveys, and the efficiency and capability of new products to be marketed for drug testing. Dr. Butler was a well known and highly regarded forensic toxicologist and pathologist, and I believe just about every drug testing survey, every product about to be marketed for testing drugs, and every new method for testing and identification of drugs were sent to Dr. Butler for evaluation, which were all given to me to perform the actual work under Dr. Butlers supervision. I spent much time on the operation, quality control, and maintenance of various instrumental testing methods including gas chromatography, ultraviolet and visible spectrophotometry, chemistry analyzers, analytical balances, and high power microscopes, as well as non-instrument testing such as thin-layer and column chromatography, adsorption and absorption extraction and elution, volatile distillation, diffusion, wet chemistry, liquid-liquid extraction, and more.

leach operation of placer gold in Searchlight, Nevada.

Atlas Chemical Testing Labs – Analytical testing and specific determinate

analysis of various materials including water, fuel, liquids, soil, gases, building materials, concrete, metals, wood, fabric, solvents, and others. Performed a large amount of fire assays to determine gold and silver content of ore samples. Conducted arson testing for flammable material for the fire department. Consulted and conducted testing on product/liability claims for insurance companies. This included investigating cracks in concrete for type, age and fault and determining the source and age of disfigurements such as damage or stains to merchandise. Conducted special requests from manufactures to measure specific parameters on new products. Managed company for three months while owner was away.

Degenerative Disease Medical Center – Consultant for setting up clinical research laboratory including methods development, laboratory testing, procedures, quality control, instrumentation operation and maintenance, specimen accessioning, handling and storage, and reporting results.
