4. SUBMISSION OF AFFIDAVIT OF DEFENSES: Print an Affidavit of Defenses form at www.ViolationInfo.com or www.cityoforlando.net/orlandostops. As the registered owner of the vehicle, you are deemed responsible for the violation and the payment of $158.00 penalty unless, by the due date, the owner can establish that, pursuant to F.S.316.0083 Florida Statutes, the motor vehicle: a. Was, at the time of the violation, in the care, custody, or control of another person. Acceptance of this assertion by City of Orlando will result in the re-issuance of the notice to the person named in the amount of $158.00;

b. Was stolen at the time of the infraction (must attach the police report); c. Violated the steady red traffic control signal to yield right-of-way to an emergency vehicle or as part of a funeral procession (please attach supporting documentation); d. Violated the steady red traffic control signal at the direction of a law enforcement officer (please attach supporting documentation);

e. Was issued a Uniform Traffic Citation (UTC) by a law enforcement officer to the driver of the vehicle for the same infraction;

f. The motor vehicle’s owner was deceased on or before the date that the uniform traffic citation was issued.

The affidavit must contain detailed information supporting an exemption, and be sworn before a notary public or another person authorized to administer oaths. If your affidavit complies with the requirements of F.S. 316.0083, no further action will be taken against you and will receive a notice of dismissal. The submission of a false affidavit is a misdemeanor of the second degree, punishable under s. 775.082 or s. 775.083, Florida Statutes, by a term of imprisonment not to exceed sixty (60) days and/or fine not to exceed $500.00.

5. CONTESTING THE VIOLATION: Please complete the Local Administrative Hearing Request form and mail to City of Orlando, c/o Orlando Stops, P.O. Box 4990, Orlando, FL 32802.
