Contracts and Procurement Manager with 30 years of work experience in delivering the full contracting lifecycle of Engineering Procurement and Construction (EPC), Design & Build, Engineering Procurement and Construction Management (EPCM) and Project Management Consultancy (PMC) contracts within Oil & Gas, Power Plant, Water, Transport and Other Infrastructure Construction projects inclusive of Civil and Structural, Mechanical and Piping, Electrical and Instrumentation, Fabrication/Installation and Commissioning Packages, acquisition of Goods and Services.

Responsible for the contract and procurement management of Onshore/Offshore Greenfield and Brownfield Energy and Infrastructure Construction projects starting from Front-End Engineering Design (FEED), Detailed Engineering Design (DED), contracting strategy development, tendering process, execution/administration until Work completion and Close-out of Lumpsum Turnkey (LSTK), Cost Reimbursable and Remeasurable (Unit Rate/Price) execution.

Planning and organizing Pre-Award activities in collaboration with the Technical and Commercial Teams resulting in the award of contract to lowest price technically compliant tender in accordance with the FIDIC (Yellow, Silver, Green and Red Book) General Conditions and Particular Conditions of Contract. Provide Project Stakeholders with the necessary assistance in identifying and resolving contractual issues/concerns during the contract formation stage.

Leading and controlling Post-Award activities in coordination with the Project Management Team (PMT), giving rise to the Scope of Work delivered Safely, on Time, within Budget and meeting Quality expectations of Stakeholders by introducing measures to streamline project execution/implementation and adherence to Risk Management Procedures in addressing the project risks associated with the administration of the contract according to FIDIC and Bespoke Forms of Contracts.

Providing contractual advice, guidance and assistance, ensuring compliance with the contractual terms and conditions as well as documenting and agreeing on any changes and the ensuing amendments that may arise during the implementation or execution of the Contract and Purchase Order (negotiating entitlements attributable to variations, settlement of claims and resolution of disputes). Reviewing all contractual documents and processing all matters relating to the Project Scope of Work and ensuring that any issues which arise are resolved as quickly and effectively as possible.

Attending meetings with the Employer and Engineer, chairing meetings with the Contractors and expediting action items in the Commercial Minutes of Meeting (MOM). Interact/interface with the PMT (Construction, Quality, Safety, Project Controls, Engineering, Procurement, Legal and Finance). Responsible for the supervision and coordination of Contract, Procurement and QS Teams, conducting ISO-9001 Internal Quality Systems Audits, reporting to the Senior Contracts and Procurement Manager and providing support to the Project Director/Manager.

Main Responsibilities:

Responsible for the delivery and completion of the Infrastructure Construction project contract for Employer / Client without Lost Time Injury (LTI), within budget, in accordance with the work schedule and Quality standard by implementing proactive and efficient management of Pre-Award and Post-Award contracting in coordination with the Design-Build Contractor.

Provide pro-active management to the ongoing procurement activities relevant to the Facilities Operations and Maintenance scope of work in collaboration with vendors and suppliers resulting in savings for the Employer/Client.

Planning, organizing, leading, coordinating and controlling the Pre-Award and Post-Award contracting and procurement activities for and on behalf of the Employer/Client, as below:

Pre-Award Activities (Call for Tender Phase):

Coordinate the Prequalification of bidders for contracting works in collaboration with the Project Manager, Contract Director and Internal Technical Teams, prepare and issue Letter of Interest to prospective bidders (Client accredited/prequalified).

Lead internal departmental review (strategies and procedures regarding contracting, scope of work, developing contract for sole source/negotiated/competitive bidding, project contractual deliverables, contract standardization/call-offs, legal matters, risk assessment, Engineering, Procurement and Construction plans, Quality and Safety plans and budgeting).

Supervise the floating of Invitation to Tender (ITT), Request for Proposal (RFP), Bill of Quantities (BOQ), Non-disclosure Agreement/Secrecy Agreement, General Conditions and Particular Conditions of Contract to interested bidders.

Arrange Pre Bid Meetings / Site visits and reply to pre - bid clarifications from bidders, issue addendum in agreement with concerned Technical Teams (Engineering, Procurement, Construction, QA/QC, Safety, Cost Control and Projects).

Determine the Base Date in order to fix the schedule of Tender Submission Date and coordinate the receipt of sealed bids (Contractor’s Proposal, Schedules and Appendix to Tender, among other Tender documents).

Supervise and participate in the Technical Bid Evaluation (after bid opening, issue clarifications and solicit individual reply to technical post bid clarifications from bidders) in collaboration with the Technical and Commercial Teams/Departments.

Supervise the conduct of Commercial Bid Evaluation of technically compliant bids (issue commercial post bid clarifications and review deviations/compare pricing), participate in price negotiations and prepare Bid Report/Award Recommendation.

Issue Letter of Acceptance / Contract Agreement to lowest price technically compliant bid, Letter of Regret to unsuccessful bidders and arrange Kick-Off Meeting and issue Notice to Commence/Proceed in coordination with the Contract Team.

Post-Award Activities (Contract Administration/Execution Phase):

Coordinate the review and acceptance of Engineering drawings and specifications, Procurement plans, Construction Work Schedule, Quality Assurance plans, Inspection and Test Plan, Manner of Execution, Performance Security, insurance, bank guarantees and bonds, Safety Procedures, Progress Report Requirements, among other contractual deliverables.

Determine the issuance of Site Instruction and Field design change against raised Technical Query, performance monitoring and evaluation (using KPIs), review/approval of progress/milestone payment certificate and validation of invoice.

Facilitate the approval of amendment to the contract attributed to the review and acceptance of variation notice, Day Works into Variation Order, determination of Contractor’s Claims, resolution of disputes by amicable settlement.

Supervise the tracking of installed materials (BOQ/IFB against IFC drawings), interpretation of contractual parameters and measurement method with direct support from Quantity Surveyors and in coordination with Procurement and Supply Chain.

Determine the implementation of applicable contractual payment i.e. Lumpsum, Unit Price (Remeasurable) or Reimbursable (Billable), cost monitoring and analysis of budget variance in collaboration with Cost Control and Finance.

Preparation of contractual correspondence giving instructions to comply with obligations under the contract and addressing non-compliance and maintenance of logs/registers of reference documents in coordination with Document Controller.

Monitor and expedite site materials delivery, vendor representative site visits / commissioning work and Factory Acceptance Test and Site Acceptance Test (FAT/SAT) activities in coordination with QA/QC, Construction and Procurement Groups.

Interact with the Team Leader and Contract & Finance Manager on pricing of Variations, preparation of periodical report to Stakeholders on project contract status and lessons learned for continuous improvement in accordance with ISO-9001.

Interface with the Employer, PMT and Contractors in resolving disputes and avoidance of arbitration proceedings (breach of contract due to non-compliance, late delivery of equipment/materials and/or slow progress of work).

Determine the flowing down of the main contract provisions into subcontract terms and conditions, alignment of procedures on contractual entitlements and compensation due to change/variation orders.

Facilitate issuance of Taking-Over Certificate and release of Retention Money after the expiry dates of Defects Notification Period (subject to the Work passing the Test after Completion), and after receipt of the Performance Certificate, instruct the Contractor to submit Final Statement prior to the issuance of the Final Payment Certificate by Engineer to Contractor.
