Congratulations! I am pleased to offer you a position as a Coach at BODY20 Cherry Creek (ZADE LLC). I think you will be a valuable asset to our team and continue to grow with BODY20 in many ways. Here is a brief outline of the proposed terms of your employment: Position Title: Coach

Status: Part-Time

Reporting Relationship: Studio Manager

Location: Cherry Creek, Denver, CO

Start Date: TBD

Base Salary: $18.24/hour during training period, $19.00/hour after EMS certification is acquired

Commissions: Open Studio: $15/membership + weekly &/or monthly individual and team incentives. Referred Members:

$25/membership sold, paid monthly (See Exhibit A)

Company Benefits: BODY20 Membership ($399/month: to use during non-peak hours)

Responsibilities

• Administer InBody evaluations.

• Train members with high level proficiency and fitness knowledge and continue to educate and grow personal training skills.

• Establish and maintain a high level of service according to company standards.

• Diligently record and review member notes before and after workouts.

• Provide a high level of personalized attention to members.

• Maintain knowledge and participation in all club services, programs and products.

• Attend all related meetings and trainings.

• Help with social media postings to promote the studio.

• Confirm demos and do outreach through phone calls, texts, and emails.

• Maintain a clean and organized studio space.

• Work as a team player to do tasks and jobs to keep the studio running well.

• Take part in regular, weekly BODY20 workouts.

• Learn weekly workouts before the start of each week. Paid Sick Time (PST)

The Colorado Healthy Families and Workplaces Act (HFWA) requires Colorado employers to provide two types of paid sick leave to their employees: accrued leave and public health emergency (PHE) leave. The following points apply to both PHE and accrued leave.

• Paid sick leave must be paid for time off work, and at the same pay rate the employee earns during the time worked.

• Paid sick leave can’t be counted against employees as absences that may lead to firing or other negative action

• Use of PST must be requested in email or writing before the applicable pay period ends. It cannot be retro active and mist happen in writing via email, not text. BODY20 Cherry Creek ~ 162 Adams Street #100, Denver, Colorado 80206 Accrued Paid Sick Leave: An employer must provide 1 hour of accrued paid leave per 30 hours worked, up to 48 hours per year. Accrued paid sick leave can be used for a wide range of health and safety needs:

• Inability to work due to a mental or physical illness, injury, or health condition.

• Obtaining preventive medical care (including vaccination), or medical diagnosis/care/treatment.

• Needs due to domestic abuse, sexual assault, or criminal harassment including medical attention, mental health care or other counseling, legal or other victim services, or relocation.

• Care for a family member who needs the sort of care listed above.

• During a PHE, a public official closed the employee’s workplace, or the school or place of care of the employee’s child.

• Effective Aug. 7, 2023: Bereavement, or financial/legal needs after a death of a family member; or

• Effective Aug. 7, 2023: Due to inclement weather, power/heat/water loss, or other unexpected event, the employee must:

a. evacuate their residence, or

b. care for a family member whose school or place of care was closed. Since January 1, 2022, all employers in the state, regardless of size or industry, are fully covered by HFWA. HFWA covers all employees (part-time, seasonal, temporary, etc.), excluding only federal government employees and some railroad employees. Employers can require documentation for accrued paid sick leave

(not for COVID-related public health emergency (PHE) leave), but only for absences of four or more consecutive days — and employees can provide the documentation after the leave ends. Job Training & Onboarding Process

You will be required to complete job training at BODY20 University as part of your onboarding process. Your training will include assessments, practical exercises, and practiced coached workouts. You will receive compensation for job training when you successfully complete all training assessments and practical exercises as outlined by BODY20 University and coaching training requirements. Once you have completed your training and received your EMS certification, you will receive compensation for the training period. Compensation will be processed in accordance with our standard payroll schedule. Performance Reviews

You will be eligible for annual performance reviews, which might lead to increases in your compensation. Your first performance review will be sixty (60) days after employment commences and your first ninety

(90) days are considered a probationary period in which either party may terminate this employment at any time for no specific reason whatsoever.

This offer supersedes any and all previous conversations or communications regarding compensation and/or terms of employment.

The offer is contingent upon your successful completion of the following, or offer can be rescinded:

Further, this offer of employment, if not previously accepted by you, will expire seventy-two (72) hours from the date of this letter, although additional time for consideration of the offer may, upon discussion, be made available if both parties find it necessary and agreeable. By signing this letter, you verify that your employment with BODY20 Cherry Creek will not violate the terms of any existing agreement you have with your current employer or any other agreement, including any non- compete agreement.

You will not bring onto premises of BODY20 Cherry Creek, or upload onto BODY20 Cherry Creek company computer systems, any unpublished documents or any property or confidential information belonging to any former employer or any other person to whom you have obligation of confidentiality unless consented to in writing by that former employer or person.

This letter does not constitute an employee contract. Employment with BODY20 Cherry Creek is considered to be “AT WILL” employment and can be terminated at any time with or without notice for any reason by either party. All salary information should be considered confidential and only discussed with the owners of BODY20 Cherry Creek.

Coach Studio Commissions & Bonus

Description - Open studio commission will be paid at the end of each month based on membership start. If employee leaves or is terminated for any reason, all unpaid commissions and bonuses will be forfeited.

Open studio Membership Commission: $15/per membership for demo workout given to prospect that becomes a member.

Example:

10 members = $150

20 members = $300

25 members = $375

30 members = $450

35 members = $525

40 members = $600

Referred Member Commission: $25/per membership sold by employee Example:

15 members = $375

20 members = $500

25 members = $625

Corporate & Studio Bonuses: There will be team and individual based bonuses to drive membership sales and teamwork. Bonuses will vary and TBD. There will be BODY20 Corporate contests and incentives as well as BODY20 Cherry Creek contests and incentives.
