As the Head of the Litigation Department, I oversee, evaluate, and actively engage in both consensual and adjudicative proceedings, encompassing:
a. Scrutinizing a variety of bilingual contracts and agreements to identify any potential risks and subsequently, formulating appropriate mitigation strategies and
implementing them, as needed;
b. Providing legal counsel to local, international and multinational clientele regarding their legal standing and potential dispute resolution options across a broad spectrum of legal issues. This includes representing their interests by liaising with third parties involved in disputes to negotiate the terms of potential settlements, with the aim of achieving an amicable resolution;
c. In cases where disputes advance to a formal dispute resolution process, I offer guidance to clients on the appropriate course of action and compile the necessary evidence to reinforce and bolster their legal position; d. If a dispute escalates to litigation, I facilitate the process by transferring the case file to one of the competent law firms with which our management has a longstanding
relationship. I then obtain a fee estimate from such law firm for handling the said dispute. Once our client(s) approve the quote, I provide comprehensive written instructions to the law firm, maintain communication and coordination with them, and monitor the progress of the case. This involves attending virtual and/or physical meetings with the law firm and our clients or their representatives to stay informed about the case's status, offering our insights, and keeping our clients updated on developments;
e. Collaborating with the aforementioned law firms to help prepare and/or review draft statements and memoranda intended for submission to federal and local courts of first instance, appeal, and cassation. This includes a diverse caseload encompassing criminal, civil, commercial, labor, real estate, rental, construction (“non-FIDIC”), corporate, and banking litigation;
f. In the event that a dispute enters the arbitration phase
"DIAC and ADCCAC", I am responsible for drafting bilingual requests for arbitration, memos, rejoinders, and any other necessary submissions;
g. Acting as the firm's representative in all preliminary procedural meetings and hearings;
h. In a broader scope, serving as the clients' representative in all arbitration cases and expert meetings; and
i. Following the resolution of a dispute or the issuance of a court judgment or arbitral award, collaborating with the relevant law firms to facilitate the enforcement of the settlement agreement or judgment/award.
