The Dow Chemical Company Contract assignment via G-Tech Services, Houston, Texas

Engineering, Procurement, and Construction (EPC) contract administration for various projects in MOSAIC Program and others. On Project Team for Fort Saskatchewan Path2Zero Project (to eliminate CO2 emissions). Solely revised draft contract for add-on equipment to existing project for CM review. Other MOSAIC Projects-Prepared SOIs and evaluated interested companies to bid on construction projects to be completed in 2023/4 and beyond. Presently in early-stage project beginnings.

Contracts Administrator/Purchasing Mar 2019 – Jan 2022

Saudi Basic Industries Company (SABIC) Contract assignment via NES, Houston, Texas

Corporate level Contracts support in Global Projects Procurement. Started with company during bidding process for PMC. Did bid analysis and evaluation to select PMC Contractor for multi-billion-dollar Greenfield Chemical plant to be built on the U.S. Gulf Coast. Send out SOIs for interested EPC companies to bid on new projects. Review mod yards for compatibility with Project. Project contract support. Due to Covid19 in lieu of lay-off, moved to Purchasing to prepare and release Purchase Orders, research invoices, submit new vendor requests, submit work requests, handle numerous Purchasing issues that arise daily.

●Pre-qualified bidders when SABIC was ready to continue Project after Covid’s impact.

Senior Contracts Administrator July 2013-Feb 2019

The Dow Chemical Company Long-term contract assignment via G-Tech Services, Sugar Land and Freeport (project site location), Texas

Engineering, Procurement, and Construction (EPC) contract administration for TIC $10+ Bn Gulfstream Program on the Propane Dehydrogenation Project (PDH1), Power Utilities & Infrastructure Project (PUI), Light Hydrocarbon Unit 9 Project (LHC9 Cracker and Expansion), and Clarified River Water Project (CRW), all located in Freeport, Texas. An intermediary between the four Owner PMs and EPC Fluor Corporation, EPC CH2M, EP Technip, and Dow for contractual issues and Project Controls for cost issues.

Pre-Award: On contracting team for several major high-value construction contracts: (e.g., Pipe Rack Module Fabrication, Refractory Installation, Field Fabricated Tanks, Pipe Installation, Instrumentation & Electrical Installation, Flare Piping Installation, Trucking, Piling, Civil Work, General Mechanical, and Chemical Cleaning & Lube Oil Flushing; commissioning and startups, and major frame agreement proposal evaluations). Pre-qualify contractors for SOI on HSE, NDA, Hold Harmless Agreements, Company Financials, and OCIP qualifications. Clarify legal terms and conditions with bidders. Develop Strategic Sourcing Plan (SSP). Participate in bid openings and negotiations, and prepare detailed bid-tab analysis for vendor selection. Recommend winning bidder with justifications.

Post-Award: On the Owner team as Prime Contract Administrator for Tier 1 EPC Fluor Corporation. Administer four Prime Contracts and various Labor Subcontracts. Verify Prime and Labor Subcontract invoices are in accordance with contractual terms on multiple 1,000-line item invoices and advise when corrections required. As needed, prepare back charge notifications to Contractor and handled contract claims. Closely monitor indirect costs for cost control/savings opportunities. Monitor each work package so as not to exceed DOA to commit values, and update PO funding requests. Issue PO change orders, prepare Contract Modifications, record meeting minutes and disseminate, and handle issues or complaints as they arise during the Contract’s progress. Exceptional understanding of taxable vs. non-taxable purchases and requirements and various contract pricing structures.

●Due to meticulous contract administration/management – won a multi-million $ contract claim.

●Major Participant on Charter Team to evaluate problem bottlenecks and mitigate findings. Result: Considerable time saved on processing payments to Contractors which resulted in on-time payments and happier Contractors whose cash flows were greatly improved.

●Provided cost savings through detailed review of contract terms. Result: Savings over $1,500,000.

●Detailed tax issues that resulted in a million dollars of savings in duplicate tax payments averted.

●Corrected numerous cost center misclassifications by ensuring billings were properly charged to the correct cost center. Result: Over $500,000 in misclassified cost centers were correctly charged and to the correct project or category.

●Developed work processes and contributed to program process improvements. Result: Saved time, especially where fast-turnaround was needed; and money on excessive costs.

Nov. 2008 – Jun 2013

Contract administration on commercial construction contracts (Caterpillar, Textron, Angus-Palm, Oshkosh, OMRON, General Dynamics Land Systems, and Daimler Trucks North America.) Lead negotiator on engineering change proposals with Government analyst on $4 billion contract. Analyze basis of estimate for pricing proposals. Develop and submit proposals. Negotiate terms and conditions to mitigate risk, protect Intellectual Property and mitigate scope creep. Develop plan for management of major contracts. Review, negotiate and sign agreements and contract modifications. Conduct contract closeouts to ensure audit compliance. Prepared schedule for submission to GSA and SAM.gov filings.

●Negotiated dozens of Engineering Change Proposals (ECPs). Result: Gained over $26 million in new revenue.

●Discovered more than $6MM in unclaimed revenue. During the contract closeout process, discovered that we had not applied for millions of dollars in earned contract work and incentives. Result: Submitted multiple claims and brought in more than $6 million in non-budgeted income.

●Made process improvements on billing procedures. Discovered that there was no standard notification to A/R to generate an invoice when a project was completed. Created a template for the performing unit to complete, when the work was finished and signed off accepted/delivered by the customer. Trained everyone on its use. Forward it to A/R stating they could invoice for the project and also send it to the client so they would have record that it was okay to pay the invoice. Result: Ensured accountability that all projects were properly closed out and billed.
