Peter Newman is an experienced lawyer who practices in the areas of Employment Law and Litigation, Traditional Labor Law, Business Litigation, HR Consulting, Corporate Compliance, Risk Management, and Business Ethics. He is also an experienced workplace investigator and a well-received workplace trainer.

In addition, Peter is an experienced mediator and arbitrator who collaborates with parties to resolve their civil disputes without the time, expense, and distraction of litigation. Peter currently serves as a mediator for the U.S. District Court for the Southern District of Ohio. He is also an American Arbitration Association trained arbitrator for employment law cases. Regarding his teaching experience, Peter has taught law school, MBA, and undergraduate law classes. He has taught both live and online classes. Employment cases are the most common civil cases on the federal courts dockets and on many state court dockets. Peter represents employers of all sizes, employees, and individuals in all areas of employment litigation with an emphasis on avoiding and defending employment law claims. 1

Peter’s litigation experience includes successfully defending clients against employment law class actions and wage and hour collective actions. Although Peter has tried a large number of cases, the majority of his cases have been won on summary judgement, settled early in his client’s best interest, or resolved cost-effectively in alternative dispute resolution procedures. Peter is an employment law “switch hitter” who will represent individuals who present compelling stories that call for workplace justice.

Traditional Labor Law:

Peter’s focus is helping clients maintain positive relationships with their workforces, whether they are unionized or not. In union organizational drives, our clients have maintained an approximate 95% win record. We have successfully negotiated collective bargaining agreements with all the major unions. We have experience helping our clients develop contingency plans for strike preparedness, including all aspects of operating a business during a strike. Since 1980, we have handled more than 150 arbitrations.

Business Litigation:

Peter represents employers and employees in a variety business litigation including business disputes, non-compete agreements, intellectual property, and trade secrets. HR Lifeguard: HR Counseling and Preventive Strategies for Avoiding Employee Claims: We advise clients on all areas of employment law including the creation of employment policies and practices, proactive audit and risk management, planning and implementation of reductions in force, performance, incentive and compensation, pre and post-employment restrictions, and data privacy. We partner with our clients’ in-house counsel, management, and HR departments to create solutions that address their unique business needs and legal requirements. Corporate Compliance, Risk Management + Ethics:

We work with companies of all sizes to achieve several goals. Using risk management, we help companies identify their legal risks. Next, we help them develop effective corporate compliance and ethics programs which address these risks in compliance with the Federal Sentencing Guidelines for Organizations. In addition, we work with Boards of Directors to ensure that Board members fulfill their fiduciary duties, including their Caremark duty to oversee their companies’ corporate compliance and ethics programs. Finally, we work with executives to help them make good business decisions regarding their respective companies’ organizations and business strategies. The Workplace Investigator:

In the post-Sarbanes-Oxley era and in light of recent highly publicized cases involving sexual harassment and executive wrongdoing, defending against employee claims - including whistleblower claims - requires strategic counsel. We advise clients on how to develop effective complaint and internal reporting procedures. Where necessary, we conduct internal investigations of claims of discrimination, harassment, retaliation, and employee misconduct, as well as an investigation of the breakdown in company policies and management 2

responsibility that produced such claims.

The Workplace Trainer is a legal compliance and consulting services company. Our interactive training courses cover employment, corporate compliance, risk management, and business ethics issues. Newman Dispute Resolution: Arbitration and Mediation Peter is an American Arbitration Association trained arbitrator. He also has extensive mediation experience. TEACHING EXPERIENCE

THE UNIVERSITY OF DAYTON, Dayton, OH 2014 to 2017 Adjunct Professor Peter taught at both the School of Law and the School of Business Administration. At the School of Law, Peter taught Corporate Compliance, Risk Management & Ethics. At the School of Business Administration, Peter taught both undergraduate and MBA students. He taught the Business Law class that all business students must take: MGT 201 - The Legal and Ethical Environment of Business. Peter also taught MBA 605A - Advanced Business Law for Accounts. This course covers the Business Law topics for the CPA exam: Agency and Regulation, Contracts, Sales and Secured Transactions, Negotiable Instruments and Documents, and Debtor-Creditor Relationships. The course also covers Ethics and Professional Responsibility. 3

SHANGHAI MARITIME UNIVERSITY/ST. MARTIN’S UNIVERSITY, Shanghai, China 10/12 and 10/13 Adjunct Professor

Through the two Universities’ teaching exchange program, Peter taught American Business Law to 260 Chinese undergraduate students in Shanghai Maritime University’s School of Business. Peter’s teaching experience involved preparing class lectures and presentations, lecturing, drafting examinations, and preparing exam reviews for the students. In addition, he gained valuable insight into the teaching environment and culture of Chinese universities. EDUCATION
