Civil Design Services, Inc. (CDS) is submitting the attached Solid Waste Permit Renewal Application on behalf of WCA of Florida, LLC (WCA) for the 8001 Fruitville Road Waste Processing Facility (Facility) located Sarasota County, Florida. Currently, the Facility is operating under the above referenced Solid Waste Operations permit.

The attached Application is a request for a renewal of solid waste operations activities at the Facility. Listed below is a general summary of the attached Application;

Attached to this letter is a Solid Waste Permit Renewal Application for the renewal of solid waste operations at the Facility. The attached application is for a twenty (20) year operations permit. An Application Fee of $4,000 ($1,000 for the first five (5) years plus 20% of $1,000 times fifteen (15) additional years over the initial five-year permit) for the Solid Waste Operations Renewal is included with this letter.

The Financial Assurance requirements, refer to Appendix C of the attached permit application, has been adjusted for quantities of C&D, Class III, Class I, special waste, waste tires, recyclable and recoverable materials onsite. Please note Yard Trash, wood, land clearing debris (covered under the Facility’s Yard Trash registration) and Clean Debris (i.e. Concrete and crushed concrete) are materials that Sarasota County requires WCA to maintain a Performance Bond with the County to cover removal and closure activities for these materials (refer to Sarasota County Municipal Code Section 54-345 for bond requirements).

RESPONSE: The 8001 Fruitville Road Waste Processing Facility (Facility) is a Materials Recovery Facility that accepts C&D and Class III materials. Recyclable and Recoverable materials that can be sorted from the in-bound waste is sorted, processed, and stored for transport to offsite recycling markets. 2. Type of Application

RESPONSE: This Application is for “Operations Without Additional Construction”. The existing yard trash facility registration will be renewed separately. Refer to Appendix A for the completed Solid Waste Permit Application. 3. Classification of Application

RESPONSE: This is a “Renewal” permit application. The Facility is currently operating under FDEP Solid Waste Operations Permit Number 155989-006-SO/31. A minor modification, Permit No. 155989-007-SO/MM, was also permitted for the operations of the Facility.

14. Anticipated Construction Starting and Completion Dates RESPONSE: Not Applicable. No Construction proposed. 15. Expected Volume of Waste to be Received

RESPONSE: Although recent tonnage has been down during the economic slowdown, the Facility was successfully processing up to 1,000 tons per day during periods of heavy incoming waste in 2006 through 2008. The processing equipment has not changed therefore the Facility is capable of handling 1,000 tons per day should the incoming waste stream increase over time.

16. Provide a Brief description of the Operations Planned for this Facility RESPONSE: The Facility accepts C&D and Class III waste materials. Recyclable and recoverable materials that can be removed, sorted, and processed for offsite recycling markets. Residual waste materials are loaded into transfer trailers and transported offsite for disposal at a permitted facility.

2. Attach a site plan, signed and sealed by a professional engineer registered under Chapter 471, F.S., with a scale not greater than 200 feet to the inch, which shows the facility location, total acreage of the site, and any other relevant features such as water bodies or wetlands on or within 200 feet of the site, potable water wells on or within 500 feet of the site (Rule 62-701.710(2)(b), F.A.C.).

RESPONSE: An updated aerial of the site is provided in Appendix E of the permit application.

Contained in Appendix F of the permit application is a well inventory map with all wells listed in the SWFWMD database within 500 and 1,000 feet of the property. One onsite well, WCP Permit No. 607809, is located south of the Administration & Maintenance building. However, this well is only an irrigation well used for supplying water for the dust control sprinklers. Potable and fire supply water is supplied a potable forcemain connection to Sarasota County Utilities.

WCP Permit No. 618969, on the northern property line is an irrigation well used to irrigate the landscaping in Londonberry Drive. This well was constructed in 1999 when the Facility was operational under “Meyer and Gabbert”. Copies of Well Construction Permit No. 607809 and 618969 have been included in Appendix F for reference.

3. Provide a boundary survey and legal description of the property (Rule 62-701.710(2)(c) F.A.C) RESPONSE: No additional property has been acquired since the last permit renewal of the Facility. The property boundary survey and legal description have been previously submitted to FDEP and remain valid for this permit renewal. 4. Provide a construction plan, including engineering calculations, that describes how the applicant will comply with Rule 62-701.710(3), F.A.C., Rule 62-701.710(2)(d), F.A.C. RESPONSE: No additional construction is proposed as part of this permit renewal application.

PROHIBITIONS

(1) General prohibition.

(a) No person shall store, process, or dispose of solid waste except as authorized at a permitted solid waste management facility or a facility exempt from permitting under this chapter. RESPONSE: The Facility is currently operating under FDEP Solid Waste Operations Permit Number – 155989-006-SO/31; 155989-007-SO/MM.

(b) No person shall store, process, or dispose of solid waste in a manner or location that causes air quality standards to be violated or water quality standards or criteria of receiving waters to be violated.

RESPONSE: The Facility has no air quality (emissions) violations. The Facility has an active NPDES Permit – FLR05G292 and no violations. The Facility has a concrete sorting floor and a leachate collection systems. No groundwater monitoring system is required for the Facility.

(2) Siting. Unless authorized by a Department permit or site certification in effect on May 27, 2001, or unless specifically authorized by another Department rule or a Department license or site certification based upon site-specific geological, hydrogeological, design, or operational features, no person shall store or dispose of solid waste:

(a) In an area where geological formations or other subsurface features will not provide support for the solid waste;

RESPONSE: Refer to Section B 1 b. of the attached Permit Application.

(b) Within 500 feet of an existing or approved potable water well unless storage or disposal takes place at a facility for which a complete permit application was filed or which was originally permitted before the potable water well was in existence. This prohibition shall not apply to any renewal of an existing permit that does not involve lateral expansion, nor to any vertical expansion at a permitted facility; RESPONSE: Refer to Section B 1 a. of the attached Permit Application. This permit application is for a renewal of an existing permit and does not include lateral or vertical expansion of the permitted Facility. Contained in Appendix F of this permit application is a well inventory map of all wells listed in the SWFWMD database. No potable wells are within 500 feet of area where waste is stored. Well Construction Permit No. 607209, is for an on-site irrigation well, constructed when the site was originally permitted.

RESPONSE: Not Applicable - the Facility is a “Waste Processing Facility” and no dewatering pit exists onsite nor is any waste disposed onsite.

(d) In any natural or artificial body of water including ground water and wetlands within the jurisdiction of the Department. This prohibition does not apply to areas of standing water that exist only after storm events, provided that the storage or disposal does not result in objectionable odors or sanitary nuisances;

RESPONSE: The Facility waste sorting floors are above grade and the sorting floors have a concrete surface with a leachate collection system to separate leachate from surfacewater runoff that could infiltrate into groundwater. In addition, stormwater is collected in a perimeter swale (along the northside of the property as well as the interior of the property and convey to a stormwater management system. Offsite discharge is covered by an ERP and NPDES permit. No waste is placed in areas that have standing water and no “objectionable odors or sanitary nuisances” have been noted.

There are no delineated wetlands onsite.

Class I waste material is temporarily stored in a cover waste bin and removed from the Facility within seven (7) days in accordance with Rule 62-701.710(4)(b) F.A.C.

(e) Within 200 feet of any natural or artificial body of water unless storage or disposal takes place at a facility for which a complete permit application was filed or which was originally permitted before the water body was in existence. This prohibition shall not apply to any renewal of an existing permit that does not involve lateral expansion, nor to any vertical expansion at a permitted facility. For purposes of this paragraph, a “body of water” includes wetlands within the jurisdiction of the Department, but does not include impoundments or conveyances which are part of an on-site, permitted stormwater management system, or bodies of water contained completely within the property boundaries of the disposal site which do not discharge from the site to surface waters. A person may store or dispose of solid waste within the 200 foot setback area upon demonstration to the Department that permanent leachate control methods will result in compliance with water quality standards and criteria. However, nothing contained herein shall prohibit the Department from imposing conditions necessary to assure that solid waste stored or disposed of within the 200 foot setback area will not cause pollution from the site in contravention of Department rules;

RESPONSE: Not Applicable - This Permit Application is for a renewal of an existing permit and does not include lateral or vertical expansion of the permitted facility. All disposal areas and wetland setbacks were defined, and have been approved, in previous permit applications. There are wetlands located in the front (southern) side of the property; however, all storage takes placed outside of the 200-foot setback from the wetland.

RESPONSE: There are no waste disposal areas within right-of ways, roads, or alleys or easements.

(3) Burning. Open burning of solid waste is prohibited except in accordance with Chapter 62-256, F.A.C. Controlled burning of solid waste is prohibited except in a permitted incinerator, or in a facility in which the burning of solid waste is authorized by a site certification order issued under Chapter 403, Part II, F.S.

RESPONSE: No burning of waste is authorized at the Facility or proposed in this Application. Refer to Section 4.3 of the Operation Plan, contained in Appendix D of this permit application, for restriction on burning of waste.

(4) Hazardous waste. No hazardous waste shall be disposed of in a solid waste management facility unless such facility is permitted pursuant to Chapter 62-730, F.A.C. RESPONSE: The Application is for a Waste Processing Facility and waste materials listed in (4) are not authorized for disposal at the Facility.

(5) PCBs. Disposal of liquids containing a polychlorinated biphenyl (PCB), or non-liquid PCBs in the form of contaminated soil, rags, or other debris, may be restricted or prohibited by 40 CFR Part 761. Persons managing PCBs are advised to consult that federal regulation before attempting to dispose of PCBs in any solid waste disposal unit in this state. RESPONSE: The Application is for a Waste Processing Facility and waste materials listed in (5) are not authorized for disposal at the Facility.

(6) Biomedical waste.

RESPONSE: The waste materials listed in (6) (a) through (c) are not authorized for acceptance or disposal at the Facility. Refer to Section 3.2 of the Operation Plan, contained in Appendix D of this permit application, for “Acceptable” and

“Unauthorized”.

(a) No biomedical waste shall be knowingly deposited in any solid waste management facility unless:

1. The solid waste facility is specifically permitted to receive untreated biomedical waste; 2. The biomedical waste has been properly incinerated so that little or no organic material remains in the ash residue, or treated by a process approved by the Department of Health, and the provisions in paragraph 62-701.520(5)(d), F.A.C., are complied with; or

3. The biomedical waste is generated by an individual as a result of self-care, or care by a family member or other non health care provider. However, in order to reduce the chance of exposure to the public, home generators are advised to segregate and package such waste before disposal according to the guidelines for disposal of home-generated biomedical waste available from each county health department.

(b) No solid waste, including treated biomedical waste, shall be commingled with untreated biomedical waste unless the solid waste is being managed in the same manner as the untreated biomedical waste.

(c) Treated or untreated biomedical waste shall not be allowed to leak into the environment during transport.

(7) Class I surface waters. The Department shall not issue a construction permit for a landfill within 3,000 feet of Class I surface waters.

RESPONSE: The Application is for a Waste Processing Facility and this Prohibition does not apply to this Facility.

(8) Special wastes for landfills.

(a) No person who knows or who should know of the nature of such solid waste shall dispose of the following wastes:

1. Lead-acid batteries in any landfill;

2. Used oil in any landfill, except as provided in Chapter 62-710, F.A.C.; 3. Yard trash in a Class I landfill, except as may be allowed pursuant to Section 403.708(12)(c), F.S.; and

4. White goods in any landfill.

(b) Whole waste tires may not be disposed of in any landfill or in any construction and demolition debris disposal facility, except as provided in Chapter 62-711, F.A.C. RESPONSE: The Application is for a Waste Processing Facility and waste materials listed in

(8) (a) and (b) are not authorized for disposal at the Facility. Refer to Section 3.2 of the Operation Plan, contained in Appendix D of this permit application, for “Acceptable” and

“Unauthorized”.

(9) Special wastes for waste-to-energy facilities. No person who knows or who should know of the nature of such solid waste shall dispose of lead-acid batteries, mercury-containing devices, or spent mercury-containing lamps in any waste-to-energy facility. RESPONSE: Not Applicable - This Permit Application is for a Waste Processing Facility and waste materials listed in (9) are not authorized for disposal at the Facility.

(10) Liquids restrictions.

RESPONSE: The waste materials listed in (10) (a), (b), and (c) are not authorized for disposal at the Facility. Refer to Section 3.2 of the Operation Plan, contained in Appendix D of this permit application, for “Acceptable” and “Unauthorized”.

(a) Noncontainerized liquid waste shall not be placed in solid waste disposal units which accept household waste or construction and demolition debris for disposal unless: 1. 2. The liquid waste is leachate or gas condensate derived from the solid waste disposal unit, or byproducts of the treatment of such leachate or gas condensate, and the solid waste disposal unit is lined and has a leachate collection system.

(b) Containers holding liquid waste shall not be placed in a solid waste disposal unit unless: 1. The container is a small container similar in size to that normally found in household waste;

2. The container is designed to hold liquids for use other than storage; or 3. The waste is household waste.

(c) Containers or tanks twenty gallons or larger in capacity shall either have one end removed or cut open, or have a series of punctures around the bottom to ensure the container is empty and free of residue. The empty container or tank shall be compacted to its smallest practical volume for disposal.

(a) No person may mix or commingle used oil with solid waste that is to be disposed of in landfills or directly dispose of used oil in landfills.

(b) Oily wastes, sorbents or other materials used for maintenance or to clean up or contain leaks, spills or accidental releases of used oil, and soils contaminated with used oil as a result of spills or accidental releases are not subject to the prohibition in paragraph (a) of this subsection.

RESPONSE: The waste materials listed in (11) (a) and (b) are not authorized for disposal at the Facility. Refer to Section 3.2 of the Operation Plan, contained in Appendix D of this permit application, for “Acceptable” and “Unauthorized”. Refer to Section 4.10 of the Operations Plan in Appendix D of this permit application for procedures for managing oily wastes, sorbents, or other materials used for maintenance or to clean up leaks and spills.

(12) Yard trash. The prohibitions of this section apply to the storage, processing, or disposal of yard trash, except that paragraphs (2)(b) and (e) of this section are modified so that the following setback distances shall apply:

(a) 100 feet from off-site potable water wells, no setback required from on-site water wells; and

(b) 50 feet from water bodies.

RESPONSE: Yard Trash, Land Clearing Debris, and wood are currently being processed or stored onsite. WCA does have the operations of the Yard Trash processing and mulching operations contained within the Facility’s Operation Plan

(Refer to Appendix D of this Permit Application). The Facility will renew it Yard Trash Registration.

(13) Tanks. The prohibitions in subsection (2) of this section do not apply to the storage or treatment of solid waste in tanks which meet the criteria of Chapter 62-761 or subsection 62-701.400(6), F.A.C. Instead, no such storage tank shall be installed within 500 feet of any existing community water
