Practice included all aspects of civil litigation, both state and federal in Illinois and Missouri

at the trial and appellate levels with particular focus on product liability and mass tort litigation.

I managed the firms personal injury and medical malpractice departments which included a staff

of attorneys, paralegals, legal assistants and a physician. I oversaw numerous mass torts which

grossed in excess of $20 million. I also continued civil litigation defense on a limited basis.

Associate and then partner at insurance defense firm with offices throughout Illinois. As a

partner, I had primary responsibility for recruiting, hiring and training new associates.

During my time at Heyl, I took or defended over 1,000 depositions and defended clients in trials

in state and federal court in both Illinois and Missouri.

Representative cases include:

Long v. Cottrell [U.S. Dist. Court for Eastern District of Missouri and U.S.

Court of Appeals for the Eight Circuit 265 F. 3d 663 (2001)]: Successfully defended

product liability claim against car hauler manufacturer obtaining a defense verdict

after a five day jury trial. Plaintiff claimed permanent back injury resulting in total

disability and sought in excess of $1 million from the jury. This verdict was listed

by Missouri Lawyers Weekly as one of the top ten defense verdicts of 2000.

Lotz v. Omni (Madison County, Illinois Circuit Court): Defended construction company

on claim for breach of contract and violation of the Illinois Consumer Fraud Act related

to construction of a $1 million house. I also successfully prosecuted clients claim for

breach of contract and mechanics lien resulting in recovery of all sums due for the

construction and a defense verdict on the home owners claim. This case was personally

satisfying because client did not have insurance and advised me prior to closing

arguments that a plantiffs verdict would result in the loss of his business.

Lamport v. Paulo Products v. Lamport (Circuit Court for the City of St. Louis):

Automobile accident resulting in traumatic brain injury to passenger in a car which drove

under a tractor trailer in Missouri. I successfully defended the third party claim against

the driver of the car who died in the accident. The case settled after a five day jury trial

immediately before closing arguments for a confidential amount paid almost entirely by

the insurer for the trucking company.

Additional experience included drafting and arguing dispositive motions for summary

judgement, improper venue and forum non conveniens. Propounded and responded to

written discovery enforced compliance through motion practice and retained expert

witnesses.

Recruited law clerks and associates from St. Louis University and Washington University

law schools. Oversaw summer clerk ships and mentored young associates in the practice

of law and billing.

Associate

This was my first job out of law school. I worked as an associate at an insurance defense firm in

St. Louis, MO. I took or defended 3-5 depositions a week for four years. I wrote and argued

motions and handled discovery on a docket of over 75 cases.

My first jury trial was in Jefferson County, Missouri in 1989 followed by my second jury trial in

St. Clair County, Illinois in 1990. Both trials were defended by myself and I handled all aspects

of the cases from voir dire to jury instructions and closing arguments. Since both cases were rear

end automobile accidents, I achieved a defense win in each by keeping the verdict below

plantiffs demand and below the claimed special damages.

I gained experience in working independently on defense files from case filing to the conclusion

of the case with little or no input from a partner. This experience taught me to be independent

and that out working an opponent is the key to beating them at trial.
