Primary Responsibilities
Reporting administratively to the Country Manager and to the Legal Director in Costa Rica and also reports to the Senior Vice President, Secretary and General Counsel of Fresh Del Monte Holding in Coral Gables, USA.
Management of all legal matters for the Group in Brazil, acting on a judicial, extrajudicial and preventive (legal opinions) basis in different areas of Business Law (taxation, civil, labor, administrative, intellectual property, environment, trade, international, and arbitration), with special managerial duties in the following areas:
(i)Elaboration and analysis of national and international contracts, including dispute settlement clauses for international arbitration conducted by the ICC (International Chamber of Commerce); Assistance in closing foreign exchange contracts, operations of intercompany loans, and investments by the international parent companies;
Note: Had the opportunity of participating in an international arbitrational suit with rules defined by the ICC;
(ii)Acquisition of properties;
(iii)Engagement and coordination of outsourced law firms for performance in civil, labor, criminal, tributary, shareholder and intellectual property litigation. Direct performance in several administrative and judicial contingencies;
(iv)Direct managerial duties at governmental organs, particularly at ministries and federal and state secretariats, and agencies. Representation and managerial duties with state and federal environmental and water resources agencies for obtaining installation and operation licenses, deforestation licenses, river water and well water usage rights, etc.
