2014 bby and between Mother Dairy Fruit and Vegetable Pvt. Ltd. a company

duly incorporated under the Companies Act having its registered office at

'Mother Dairy' Patpargang, Delhi-110092 (Hereinafter referred to as "The

Dairy" which expression shall, unless repugnant to the context or meaning

thereof, include the successors in interest and assigns) of the FIRST PARTY

through its Authorised Signatory, Mr. Ram Kumar Sharma.

AND

Mr. Ram Kumar Sharma S/o Sh. Kidar Singh permanent resident of House No.

1355/5, Patel Nagar, Gurgaon (Haryana) and presently residing at

(Hereinafter referred to as 'The Concessionaire' which shall include

his/her legal heirs, successor, agents, servants and employees) of the

SECOND PARTY.

A. WHHEREAS the Dairy is engaged in the business of selling

liquid/packed milk, milk products and other food articles and is looking

for the person who is honest and able to run the milk booth of the company

and sell the products to the public at large.

B. WHEREAS Mr. Ram Kumar Sharma S/o Mr.Kidar Singh has approached the

company and has represented that he is interested in getting milk booth

from the company and to be appointed as the concessionaire off the company.

C. WHEREAS the company has agreed to sell and deliver the same to the

Concessionaire at Dairy's Milk Shop No. 917 located at Sector- 15, Part-II,

Gurgaon((Haryana) and the Concessionaire has agreed to purchase and further

sell the same to the public at large. Both the parties have agreed to work

together on the following terms & conditions.

NOW THEREFORE IT IS HEREBY AGREED by and between the parties as follows:

1.1 This agreement shall be valid for the period of years

dated executed by him in favour off Mother Dairy Fruit &

Vegetable Pvt. Ltd. (Hereinafter referred to as the "MDFVPL") and in case

the Concessionaire makes any default therein or commits breach f any of the

terms and conditions of the said agreement, We. The guarantors, hereby bind

ourselves jointly and severally to pay to the MDFVPL Rupees

only each of us to cover any loss or damage or penalty by reason of such

default as per the terms of the said agreement. We further agree that any

variation of the terms of the said Agreement made with the Concessionaire

will not discharge us from our liability under the Surety Bond. We have

read the original Agreement made by the MDFVPL with Concessionaire. Our

liability shall be joint and several with that of the Concessionaaire.
