• Managed the two largest ATV recall campaigns in the company’s history and their resulting litigation.

• Won a defense verdict in a wrongful death case, with exposure of twenty million dollars.

• Negotiated settlement of an adverse verdict by 40%, a cost savings of one million dollars.

• Responsible for managing the defense of all asbestos claims and lawsuits. • Negotiated and drafted a mutual defense agreement on behalf of Kawasaki Motors Corp., U.S.A., American Suzuki Motor Corporation and KYMCO USA, regarding product designed and/or manufactured by their foreign-parent companies but sold by their American competitors.

• Drafted all Race Team and Athlete Agreements for all sanctioned racing environments.

• Negotiated and drafted the Title Sponsorship Agreement with Monster Energy Corporation.

• Managed the drafting of a Master Services Agreement that outsourced all of Kawasaki Motors Corp., U.S.A.’s parts distribution services to UPS, including transfer of ownership of property and retention of displaced employees.

• Assisted in creating the most comprehensive and industry leading Dealer Agreement for use between Kawasaki Motors Corp., U.S.A. and its entire dealer body. REGULATORY COMPLIANCE

• Implemented internal procedures to ensure compliance with Section 111 of the Medicare, Medicaid and SCHIP Extension Act of 2007, between Kawasaki Motors Corp., U.S.A. and the Centers for Medicare and Medicaid Services.

• Redrafted all athlete agreements that involved minors pursuant to California Family Code Section 6753

(Coogan Law) and closely monitored their compliance.

• Provided guidance and drafted documents permitting the quick sale of Kawasaki brand products to domestic military upgrading companies so that our modified product would comply with the Buy American Act (41 U.S.C. Section 10a and Federal Acquisition Regulation Section 25.1) and be ready for use in combat operations.

• Oversee all marketing compliance with FTC regulations. Representative Litigation

FEDERAL COURT

• Whirley v. Kawasaki, U.S., Western District of Tennessee (2007). Successfully defended a product liability claim which alleged a wrongful death was caused by the improper design of an ATV’s reverse power assist switch.

• Smith v. Kawasaki, U.S., District of Maryland (2005). Managed the defense of a product liability claim, involving a recalled ATV steering component that resulted in severe brain injury and negotiated its settled on appeal.

• Rentz v. Stutz, U.S., Central District of California (2000). Prosecuted and won a judgment in favor of client for the repayment of capital and interest, arising from defendant’s breach of contract and fraudulent business practices involving secured loans. STATE COURT

• Eaton v. Kawasaki, CA, Orange County & 2d District Court of Appeals (2000-2002). Won a defense verdict of a product liability claim, alleging a defective PWC hull resulted in brain injury/quadriplegia. Drafted the prevailing response brief, upholding the trial verdict that rider error was the sole cause of the subject incident.

• Gomez v. Dinwidde, CA, 2d District Court of Appeals (1999). Alleged employer negligence resulted in the wrongful death of a construction worker, which plaintiffs sought to use to hold property owner liable. Drafted the winning response brief, upholding the lower court’s granting of a motion for summary judgment, based on the special employment defense. ARBITRATION

• Attack Performance v Kawasaki, JAMS (2014). Successfully defended a dispute wherein a former race team owner claimed he was owed money resulting from a breach of contract. Coordinated internal investigation, managed discovery, pleadings, and settlement negotiations.
