WV CARES is a State program created as the result of the Affordable Health Care Act to protect West Virginia’s most vulnerable population by requiring registry prescreening and State and Federal background checks for all direct access personnel of covered providers and covered contractors. Duties as a Fitness Determination Specialist consists of the following:

•Extensive review of background checks for each applicant entered into the WV CARES system to determine if the applicant is eligible or ineligible to work with a covered provider or contractor according to the WV CARES rule.

•Responsible for answering high volume of telephone calls and email inquiries from applicants, providers, etc. to provide guidance regarding WV CARES determinations, compliance, variance procedures, etc., as well as providing answers to technical questions regarding the WV CARES system.

While working for the BCSE State Office, from May 2013 through December 2014, I worked as the State Office Paralegal. I was promoted to Child Support Specialist III in the State Parent Locate Unit of BCSE effective January 1, 2015. Thereafter, my duties continued to include most of the duties of the Paralegal, as well as the duties of the Child Support Specialist III for the Locate Unit.

The duties of Paralegal for the BCSE State Office consisted of the following:

•Served as Bankruptcy Coordinator for all 55 counties of BCSE cases with a domestic support obligation. Duties as Bankruptcy Coordinator included maintaining and updating a spreadsheet of all bankruptcy correspondence received, the Debtor of a domestic support obligation case, the case number, the BCSE’s case identification number and the type of bankruptcy case filed (Chapter 7, Chapter 11 or Chapter 13), for tracking purposes. Prepared and filed the appropriate pleadings and supporting documentation with the United States Bankruptcy Courts to support the BCSE’s position and to protect any arrears or current support owed to caretaker and/or the State.

•Assisted the Deputy Commissioner of the BCSE with scheduling of meetings, creating agendas for meetings, preparation of documents for meetings, and preparation of correspondence, as requested. Pursuant to the request of the Deputy Commissioner, participated in numerous committees within the BCSE. This task required taking very detailed notes, taking part in decision making activities, establishing deadlines, assigning tasks to employees/committee members, as well as follow-up with committee members to ensure the tasks assigned were completed in a timely manner.

•Created the BCSE ALL Newsletter which provided a summary of each unit within the BCSE State Office, regional and county offices’ accomplishments and statistics for a specific reporting period (usually a month). The BCSE ALL Newsletter also included announcements, collections, status of projects, etc. and typically consisted of 25 or more pages. The Newsletter was prepared monthly and was approved by the Commissioner of BCSE and forwarded to all BCSE employees, as well as the Secretary of the Department of Health and Human Resources.

•Assisted many other units within the BCSE State Office with various projects. These projects varied from preparation of charts or spreadsheets, scheduling interviews, updating Training Desk Guides and Policy, etc.

•Assisted the Legal Unit of the BCSE State Office with research, preparation of legal pleadings, as well as various other tasks, as requested (in addition to bankruptcy cases).

•Corrected formatting errors, as well as created numerous fillable PDF forms, documents, etc. for use by the BCSE to improve the function of the office.

Duties as a Child Support Specialist III in the State Parent Locate Unit (Locate Unit) consisted of the following:

•Worked numerous reports generated by the BCSE database to assist in verification of social security numbers, location of parties to a child and/or spousal support case (both in state and out of state), error reports regarding parties’ addresses, Social Security Numbers, employers, etc. At any given time, the Locate Unit consisted of over five thousand cases in locate status.

•Locate attempts consisted of utilization of numerous resources including LexisNexis, social media, online newspapers, Division of Corrections reports, Regional Jail Daily Incarceration Reports, etc. The BCSE database/system also interfaced with a vast array of federal and state programs to assist in the location of parties to child and/or spousal support cases.

•Prepared and mailed numerous letters and correspondence to many federal and state agencies, as well as acquaintances of a party to a case in Locate status, financial institutions, etc. in an attempt to verify location and/or employment of parties to child and/or spousal support cases. Interacted with other states to assist in their Locate efforts, as well as requested assistance from other states in West Virginia cases in Locate status.

•Compiled a monthly report at the end of each month which consisted of an accounting of all tasks completed for the State Parent Locate Unit during that specific month.

Senior Benefit Advisor: Sep 2012 – Feb 2013

Medicare Pathways, Inc. (formerly American Senior Choices, Inc.)

Responsibilities included telephone sales of Medicare related insurance for more than twenty insurance companies offering Medicare supplements, Medicare Advantage and Prescription Drug Plans. Sales of this type of insurance involves strict compliance with the Center for Medicare and Medicaid Services’ Rules and Regulations regarding soliciting of Medicare-related insurance.

I am a licensed producer/agent in the State of West Virginia for Health and Life insurance.[1] Accomplishments while employed with Medicare Pathways, Inc. include: November 2012 Agent of the Month, which also included breaking a sales record of Medicare plans for one month. Feb 2013 – May 2013:

Continued employment with Medicare Pathways, Inc. as content writer for the Medicare Pathways’ website. Duties as a content writer included research of issues pertaining to Medicare and Medicare insurance and preparation of informational articles and blogs. Duties as a Workers' Compensation Paralegal included working closely with clients and attorneys. Prepared case summation regarding issues being litigated which included understanding of the treatment guidelines, return to work efforts, impairment awards, etc.

Duties also included maintenance of existing files, as well as new file set-up and maintenance to ensure each file was organized and up-to-date at all times. Created and maintained a database in Access for the purpose of recording all claim information and deadlines. The database included the status of all claims and issues either currently in litigation or issues which litigation had ended. Monitored claim status and all deadlines associated with each issue. Maintained a complex calendar which included, but was not limited to, return to work dates, appointments for evaluations, treatment guidelines, expirations of time frames for submission of evidence, hearings, depositions, medical evaluations, status up-dates to clients, as well as deadlines for filing of briefs, petitions, responses and motions before each tribunal.

More specific duties included drafting of legal documents under the supervision of an attorney. These legal documents varied from standard form letters to detailed legal pleadings. Examples of these documents included, but were not limited to, the following:

• Motions and Responses to Motions.

•Closing Arguments.

•Findings of Facts and Conclusions of Law.

•Medical record summaries for attorney and expert witness review.

•Drafting of Appellee and Appellant Briefs to the Workers’ Compensation Board of Review.

Additional duties during the litigation of issues protested included the following:

•Scheduling medical evaluations.

•Preparing Interrogatories specific to injury.

•Review medical records for relevant information to assist claim litigation and prepare submission letters submitting any relevant medical information into evidence.

•Scheduling of depositions of claimants, witnesses, and expert witnesses.

•Coordinating hearings and preparation of notices of hearings.

Drafting of legal pleadings, such as Briefs, Petitions, Responses to Petitions, as well as Closing Arguments required research, interpretation and application of the appropriate law, statute, and state rules and regulations to support the argument being made before each tribunal.

Additionally, during the first six years of employment with the Office of the Attorney General, duties included filling in for secretaries during absences for each attorney in the Tax Division, including the Senior Deputy Attorney General. This included working in the areas of law such as tax law, tobacco litigation and DUI. These duties were performed in addition to the workers' compensation paralegal duties discussed above.

Duties also included preparation of standard form letters, preparation of checks for payment of litigation expenses, as well as transcription of hearings and letters.
