August 2016 to date - Senior Commercial & Contracts Manager With an international PMC, procuring US$200m worth of contracts for a major Malaysian conglomerate on a major sports complex refurbishment to host the 2017 SEA Games, in Kuala Lumpur, Malaysia. Including assessment and recommendations for cost and time claims from various package contractors. Reporting to main project proponent on all commercial & contract issues, budgets, subcontract costs and procurement issues.
May 2005 to February 2016 – Senior Commercial & Contract Advisor With a major Japanese (top 5) contractor in Dubai & Qatar. Working primarily and partially resident in the Doha office, but with shared times in Dubai. Running the commercial & planning departments of the Doha office (a staff of up to 45), dealing with all day to day commercial and contract related issues. Generally on the Doha International Airport project, on various tender submissions and the CP19 package which was successfully tendered at US$250m & completed at US$900m. This also entailed the management and supervision of 20 claims personnel, drafting time and cost claims, submission and negotiation of the same. (Claims valued at US$300m). This also included working with a major international law firm, (Simmons & Simmons) with a view to a mediation and/or arbitration submission. This process never materialized as all claims were finally negotiated. This was a FIDIC based contract. During the same period and for the same company, I was also the Senior Commercial Advisor on the Dubai Airport Expansion project. (Emirates Terminal 3 & Concourse C). The company was part of an international joint venture with major Emirati and South African joint venture partners. (During the course of the project, the Emirati company was taken over by a major Australian construction conglomerate). During the early period my role was overseeing the commercial aspects of the project on behalf of my employer and presenting commercial and contract reports to the Tokyo head office. Once the project was completed, a dispute arose and I was then seconded on to the JV Management Board with a joint responsibility (with other JV Partner commercial leads) to manage an arbitration process for a claimed amount of US$1,050 million. This dispute management process involved managing three separate claims consultants, (with over 25 senior claims personnel) and two international law firms, Pinsent Masons and Freshfields Bruckhaus Deringer. Again this contract was a FIDIC based project.
January 2005 to December 2006 – Senior Commercial Manager Taiwan High Speed Rail Project, (2 packages – Yun Lin, Chaiyi). Management role with an on-site staff of 10 experienced QS & Commercial personnel. Dealing with all commercial & contracts issues on the project from tendering & subcontract procurement to finals accounts, mediation and final negotiations with THSRC. Planning & EOT functions were also under my remit & formed part of a final mediated/negotiated closure strategy.
June 1998 to September 2004 – International Commercial Coordinator Similar to the above, this period entailed commercial & contract management of the Manila International Airport Terminal 3 project, with a team of 20 commercial staff. In this instance, I was also charged with the management of the project QA/QC process
(6 senior staff) and the planning functions (4 senior staff). Whilst the project was completed on time and within budget, a major dispute arose between the Project Concessionaire and the Government of the Philippines which spilled over into a dispute down to the Main Contractor. Unusually for a major construction project, the usual arbitration clauses were replaced by a series of legal court proceedings which entailed a submission through the UK Courts followed by a transfer of any award to the Philippine Courts. This process was managed by myself & a team of 10 commercial staff plus a team of local (Philippine) and international lawyers from Minter Ellison (HK Office). On this project I was also engaged by the UK Courts as a Quantum Expert Witness, submitting a number of valuation reports. CURRICULUM VITAE
