Develop and investigate new matters. Engage in all aspects of
complex litigation, including drafting pleadings; coordinate
case management/strategy amongst plaintiff groups and government enforcers;
discovery coordination; and motion practice.
Current matters include:
In re: American Express Anti-Steering Rules Antitrust Litigation, MDL
No. 2221 (E.D.NY.). Action alleging American Express rules prohibiting
merchants from any act steering a consumer from using a lower priced
payment card product, such as surcharging and discounting, resulted in
higher merchant fees, higher retail prices, and other harm to
competition.
Laumann et al. v. National Hockey League et al, No. 12-01817
(S.D.N.Y); and Garber et al v. Office of the Commissioner of Baseball
et al., No. 12-03074 (S.D.N.Y.). Action alleging the National Hockey
League and Major League Baseball separately entered into agreements to
eliminate competition in the distribution of their respective games
over the Internet and television with various clubs within each
league, regional sports networks, and multichannel video programming
distributors.

Conducted complex antitrust investigations and litigation concerning
horizontal and vertical restraints of trade, monopolization, and other
anticompetitive acts in violation of federal and/or state antitrust laws,
often in collaboration and coordination with other state attorneys general
offices and federal antitrust agencies (United States Department of Justice
and Federal Trade Commission); held leadership and management positions in
multistate investigations and litigation.
Investigatory: Conducted confidential government antitrust investigations.
Duties included:
. Drafted, issued, and enforced investigatory subpoenas (requests for
information);
. Took investigatory statements and conducted informational interviews;
and
. Responded to party, third-party (customers, competitors, advocacy
groups), and public inquiries.
Clients: Represented, assisted and managed litigation compliance, and
counseled, major New York State agencies, as well as New York State
political subdivisions, quasi-governmental entities, and other public
entities.
Litigation: Litigated federal and state antitrust matters, including
distribution, marketing, and intellectual property in many different
markets, including pharmaceutical, technology, financial, and retail.
Duties included:
. Case strategy and expert (economic, industry) coordination;
. Substantial motion and appellate practice;
. Discovery, including substantial document review and extensive
experience handling e-discovery; and
. Settlement negotiation, mediation, approval, and administration.

Transaction Review: Reviewed the competitive impact of mergers and
acquisitions in a multitude of industries, including airlines (United-US

(Exxon-Mobil), supermarkets (A&P-Pathmark), publishing (Thomson-West
Publishing), enterprise software (Oracle-PeopleSoft), and waste management.
