Duties included, on behalf of the Erie County Medical Center, coordinating with the ECMC Quality Assurance Department and Hospital Management/Administration to develop corrective actions for identified issues; teaching/inservicing of ECMC staff; pre-litigation investigations of medical malpractice claims; review of pleadings and preparation of same; requesting authorizations and various records for claimants`/plaintiffs`; review and organization of records; preparing reports regarding medical issues involved in the case; research and obtainment of relevant medical texts and articles; interviewing of nurses, physicians, or other hospital personnel regarding claims; witness preparation; attending examinations before trial of claimants, plaintiffs and co-defendants; scheduling and coordinating physical examinations of claimants and plaintiffs; obtaining and coordinating medical experts; attending trials or other pre-trial proceedings; preparation of expert affidavits for summary judgment motions and expert disclosure statements; participating in reserve setting case reviews; acting as a resource person for various hospital departments for preparation of policies and addressing of patient care issues and confidentiality/disclosure-related issues; resource person for ECMC`s General Counsel, FOIA Officer and Compliance Officer, as well as for the Department of Health, including the Medical Examiner`s Office; sole responsibility for reporting all ECMC medical malpractice cases to the NYSDOH/OPMC as per State and Federal Law; responding to inquiries made regarding medical-dental staffs` medical malpractice history in connection with credentialing processes; and acting as a support person for any member of the hospital`s staff that needed to testify in a non-ECMC related matter. When Resident Physicians named as defendants in actions required assistance with privilege, license and/or malpractice insurance applications, I acted as their liaison and provided correspondence and supporting paperwork as needed for their applications. When one of our Attending physicians had a positive medical malpractice history involving ECMC, any request made for his or her malpractice history that required explanation was also forwarded to me for handling. I acted as a resource person for all personal injury cases within the Erie County Attorney`s office and when time permitted, I took a more active role in handling medical and damages issues on the personal injury files. I had also been called upon over the years to assist our sister office, the Erie County District Attorney`s Office, with the handling of medical issues in their criminal cases and with the coordination of hospital staff for testimony in criminal matters.
