The murder trial of a repeat DUI offender accused of causing a fatal hit-and-run crash ended Friday and will resume March 7 and 8 with cross-examination of the prosecution's expert toxicologist, followed by the defense's case, according to chief deputy prosecutor Tim Barker.
Travis Wagner Fowler, 30, of 554 Jamison Road in Lower Windsor Township, is charged with third-degree murder, homicide by vehicle while driving under the influence, DUI, driving without a license and a number of other offenses. He remains free on bail.
This is his fifth DUI charge, according to court records. At the time of the 1 a.m. July 19, 2008, crash on Route 30 in Hellam Township, he was on probation for drunken driving. The crash killed motorcyclist Nelson E. Newcomer, 56, of Millersville, Lancaster County.
A blood test determined Fowler's blood-alcohol level was 0.22 percent, according to his arrest affidavit. In Pennsylvania, an adult is driving drunk at 0.08 percent.
According to prosecution testimony, Fowler was going about 100 mph on Route 30 eastbound near the Hallam exit when he ran over Newcomer and fled the scene without even braking.
Instead of a jury, Common Pleas Judge Richard K. Renn will determine Fowler's guilt or innocence.
