Responsibility for assigned claims, from inception to
closure, including the investigation and determination of
coverage; issuance of coverage position documents;
negotiation of formal/informal cost share agreements; the
selection, retention and management of defense/coverage
counsel; the review, auditing and processing of defense
invoices; the establishing of accurate and verifiable
reserves; analyzing and recommending settlements within
$100,000/claimant authority; monitoring, documenting and
enforcement of limits, deductibles and self-insurance
features; maintaining claims and files in compliance with
all applicable regulations and company/industry best
practices and through the use of available/emerging
technologies;
I served as a resource to the company and industry on
matters of insurance coverage, legal trends and the claims
environment, reporting to Argonaut senior management, and
provide advice and consultation to other Argonaut business
units regarding their A&E exposure;
Managed and directed complex litigation involving the
company on a nationwide basis. I was responsible for
determining whether to initiate litigation on behalf of the
company, including determining the nature of the claims to
be litigated, as well as selecting the venue, counsel and
parties involved;
Responsible for reducing liabilities in A&E claims, many
involving nine-figure exposures, via policy buy-backs,
coverage in place agreements, Bankruptcy resolution,
including 524(g) Trusts, and traditional settlements.
Exceeded claim reduction goals by at least 100% for past
six years;
Participated in matters involving reinsurance, including
the evaluation of treaties and facultative certificates,
reinsurance reporting, claims management and strategy, and
have managed reinsurance disputes, including arbitrations,
resulting in significant recoveries to the company.
Advised and protected company from bad faith claims, and
evaluated opportunities to establish new legal precedents
in matters of importance to the company and the industry as
a whole.
2000 BOLLINGER, RUBERRY & GARVEY, Chicago, IL
to 2003 Handled complex insurance, personal injury and environmental
coverage litigation. During this period, I represented primary
and excess insurers in litigation, and counseled those entities
in pre-litigation claims environment. Significant cases included
counseling an excess carrier in a catastrophic mass torts claim
involving the collapse of a pedestrian walkway at an auto
speedway, representing an insurer in a 2 month jury trial in
California involving breach of an agency agreement, including
bad faith and statutory violations, and obtaining summary
judgment on a coverage claim involving shareholder litigation
against a D&O policy, later affirmed by the 5th. Circuit in; TIG
v. Pinkmonkey.com, 375 F.3d 365 (2004).
1998 MERLO, KANOFSKY & BRINKMEIER, Chicago, IL
to 2000 Handled complex insurance, personal injury and environmental
coverage litigation. This period involved litigation of aviation
disasters, from on scene investigations to trial preparation,
and concerned well publicized crashes such as Comair Flight 3242
outside Detroit, and the Aon/Alberto Culver Gulfstream G-4 Crash
at the Palwaukee, Illinois Airport (Reported in; Mio v. Alberto
Culver, 306 Ill. App. 3d 822, 715 N.E.2d 309 (1999)). I
represented insurers in complex coverage matters, including
aviation hull and liability coverages, and advised and
represented insurers in traditional A&E matters as well as the
then emerging issues of Diet Drug and Electromagnetic Field
litigation.
1995 BLATT, HAMMESFAHR & EATON (formerly ROSS & HARRINGTON),

Represented airports, airlines, aircraft manufacturers and
lessors, pilots, fixed base operators, mechanics and aviation
insurers in litigation and insurance coverage matters. This
boutique law firm offered litigation services in almost every
aspect of aviation, from defending traditional personal injury
lawsuits in multi-fatality aviation crashes, to representing
aviation entities in administrative actions and lobbying state
and local authorities on behalf of aviation concerns.
1993 HASKELL & PERRIN, Chicago, IL
to 1995 Handled environmental coverage litigation at a time when many
of the now firmly established coverage defenses were being
initially litigated for the first time. These defenses included
the sudden and accidental pollution exclusion, expected and
intended/fortuity defenses, allocation schemes and exhaustion
issues. These cases were discovery and drafting intensive,
involved extensive trial preparation in many high profile
environmental cases, such as Wisconsin Natural Gas, Stay Right
Industries, Dow Breast Implant Litigation, Baxter Hemophiliac
Litigation, Gould Industries and, the Thomas Solvent/Verona
Wellfield litigation. At the same time, I began working in the
area of aviation defense in a number of products liability cases
for a major aircraft engine manufacturer.

to 1993 As both a law clerk and newly licensed associate, I assisted in
the defense of a major gasket manufacturer in hundreds of
asbestos personal injury cases filed in Michigan. Additionally,
I defended governmental entities in complex tort litigation and
insurance coverage issues, with an emphasis on the defense of
County Road Commissions in highway liability cases arising from
complex multi-fatality vehicle accidents.
