failure to complete all sections may result in substantial delay in the
processing of this case. We may require additional information following

status to that of permanent resident.
6. Copy of Form I-20-ID, Certificate of Eligibility for N/A

H-1B PETITION (Specialty Occupation)
The H-1B visa classification is reserved for foreign nationals that are to
be employed in a specialty occupation related to the position offered. A
specialty occupation is one that requires the attainment of a bachelor's or
higher degree, or the equivalent, in the field of endeavor.
The H-1B petition is submitted to the U.S. Citizenship and Immigration
Services ("USCIS"). Those foreign nationals that are in the U.S. in a
nonimmigrant visa classification other than H-1B (such as F-1) may not
depart the U.S. until after the petition has been approved. Once approved,
the original petition approval notice (Form I-797, Notice of Action) will
be provided to the foreign national employee ("Beneficiary").
Approval of the petition allows the Beneficiary to be employed in the U.S.
only by Capgemini ("Capgemini" or "Petitioner") and as detailed in the
petition. A visa allows that Beneficiary to be admitted into the U.S.
Therefore, after the petition has been approved, the Beneficiary must apply
for the corresponding H-1B visa at a U.S. Consulate abroad in order to be
admitted into the U.S. Information on how to apply for a visa at a
particular consulate is available by calling the consulate or at
http://travel.state.gov/ Canadian citizens are exempt from the visa
requirement and may apply for admission (with the aforementioned Form I-
797) into the U.S. at an authorized port-of-entry.
Dependents (spouse and children under the age of twenty-one) are eligible
for H-4 derivative status. If a dependent is in the U.S., an application
requesting H-4 status will be submitted to the USCIS with the H-1B
petition. Dependents who are abroad do not require a separate application.
They may apply for an H-4 visa at a U.S. consulate by presenting the
Beneficiary's original H-1B petition approval.
A petition is initially granted for a period of three years, with an
extension of up to three years for a maximum period of stay in the U.S. of
six years. Time spent in another H sub-classification or L status is
charged against the allowable time in H-1B status. Under certain
circumstances, a Beneficiary with either a PERM pending for 365 days or an
approved immigrant petition with their priority date not current may be
eligible for an extension beyond the six-year limit.

pending. Capgemini employees filing extension applications must be present
