New Jersey manufacturing property by U.S. EPA. Avoided litigation and settled matter
through legal research, exhaustive factual research regarding client’s 19th and 20th century
manufacturing operations, and first-hand negotiations with U.S. EPA.
Representing multiple national and state business and industry organizations in defense of
the validity of the NJDEP “Waiver Rule.” Primary draftsman of legal arguments within
prevailing brief filed with the Appellate Division of the New Jersey Superior Court and
within brief opposing certiorari filed with the New Jersey Supreme Court.
Represented commercial waste hauler in concurrent matters before New Jersey Office of
Administrative Law, the Appellate Division of the New Jersey Superior Court and the New
Jersey Supreme Court regarding potential revocation of client’s operational license. Lead
draftsman of emergent motions filed with the Appellate Division and Supreme Court on
extremely expedited timelines. Successfully obtained stay of revocation.
