Position Description

Under the direction and supervision of attorneys within the Office of County Counsel or District Attorney, this position provides hands-on, paid public agency experience while working on interesting and challenging projects within the areas of civil or criminal law.

DISTINGUISHING CHARACTERISTICS:

This is an entry-level extra-hire classification assisting attorneys with researching legal issues; preparing memoranda; assisting in drafting resolutions and ordinances and reviewing contracts; attending court or administrative hearings, settlement conferences, and mediations; responding to Public Records Act requests; and working in close contact with policymakers and staff. Incumbents may be assigned to the County Counsel or the District Attorney's Office. Appointments to the classification are temporary while awaiting admission to the bar.

Research and analyze legal questions and relevant authority.

Draft correspondence and memos.

Prepare drafts of legal documents including motions, petitions, declarations, and other documents for use by District Attorney or County Counsel attorneys.

Review records and respond to Public Records Act requests.

Provide a wide range of legal support, administrative duties, and other duties as assigned.

Incumbents assigned to the District Attorney's Office may also prosecute infractions, and may appear and present evidence in preliminary hearings, motions to suppress, arraignments, juvenile proceedings, motions for discovery, and violations of probation.

Minimum Qualifications

The following generally describes the knowledge and ability required to enter the job and/or be learned within a short period of time in order to successfully perform the assigned duties.

Knowledge, Skill and Ability to:

Perform competent legal research.

Communicate clearly and concisely, both orally and in writing.

Interpret, apply, and explain applicable federal, state and local policies, procedures, laws, codes and regulations.

Maintain professionalism when interacting with members of the public, court staff, opposing counsel, victims, witnesses, clients, and all other persons or entities encountered in the performance of post-bar clerk duties.

Compile, maintain, process, and prepare a variety of records and reports.

Maintain confidentiality.

Establish and maintain effective working relationships with those contacted in the course of work.

Training, Experience and Certifications:

Graduation from an ABA- or CBE-accredited law school.

Completion of the California State Bar exam prior to starting employment and waiting for exam results. Individuals who have taken the California State Bar exam more than twice without passing are not eligible for this position.

Placement in the District Attorney's Office requires enrollment in the California State Bar's PTLS Program as a Certified Law Student prior to employment (Cal. Rules of Court, rule 9.42).

Special Requirements

Consent to and pass a background check. For placement in the District Attorney's Office, passing the background check includes meeting DOJ security requirements. Post-bar clerks who have other outside employment must disclose employment to the office for review and approval prior to accepting this position.

Extra-Hire:

Extra-hire employees are not eligible for step advances, vacation, seniority rights, holiday pay or other certain employee benefits. They are entitled to 24 hours of sick leave per year and eligilbe for the county's CORE Medical plan but not eligible for dental or vision insurance.

Vacation days:

0 - 3 complete years = 80 hours per year.

After 6 months you can take your first week.

3 - 10 complete years = 120 hours per year

10 years+ = 160 per year

Holidays: 14 paid holidays per year.

Sick Leave: 12 days annual sick leave accrual with unlimited accumulation.

Sick leave is accrued at 3.69 hours for each full 80 hours of payroll period.

60 hours of sick leave can be used for immediate family, parent spouse, child or sibling.

Management Time Off (MTO): 40 annually, pro-rated if hired on/after July 1st.

Merit: After successfully completing twenty-six (26) pay periods, a 3.5% merit increase may be granted. Merit increases may be granted annually thereafter to the top step.

Probation Period: New employees remain in a probationary status for 26 pay periods.
