The role will be supporting to drive the mission of the corporate culture that embraces integrity in our operations, consistent with the core values and principles of Guerbet's business ethics. This includes providing subject matter expertise and leadership on compliance-related matters within the subsidiaries and fostering a proactive compliance program and ensuring that the subsidiaries follow through on implementing a plan to continuously assess and enhance processes, maintaining controls that are effective in managing identified risks in a manner that are easily understood and applied.

The role will also be assisting in driving risk assessments in compliance, monitoring key control areas, ensuring that the local key stakeholders are informed on relevant risks and implementing remediation plans. The role will help the business to deliver sustainable business strategies, drive the right behaviors through communication and training, and is responsible for helping shape the external environment through driving industry standards that are ethical and consistent with Guerbet's core values and policies.

The role will preferably base in China and reports into APAC Head of Legal Affairs in Hong Kong and works in full cross-functional way with all the other functions/departments, and coordinates with Guerbet HQ’s HCP and Anti-Corruption Compliance Department at group levels in full alignment with Guerbet corporate compliance strategy.

Job Responsibilities

Identify and assess the compliance risks associated with the organization's distribution related business activities, including distributors’/CSOs’/Promoters’ selection/registration, sales conduct, discipline, complaint and any other related matters.

Develop and implement written compliance policies, guidelines, and SOP for distributors/CSOs/Promoter channels on the appropriate implementation of the laws, regulations, rules, code of conduct, standards, and best practices

Assess the appropriateness of compliance policies, procedures and guidelines related to the distribution channels, ensure a follow-up of any identified deficiencies, make recommendations for amendments, where necessary, and supervise the implementation of corrective measures to mitigate the identified deficiencies.

Ensure allegations of misconduct are timely reported pursuant to established policies of the company.

Assist to conduct and report internal investigations and maintain confidentiality of information when necessary.

Conduct compliance training to the distributors/CSOs/promoters and deploy global training.

Develop and conduct staff compliance training on a regular basis.

Fully understand the complex landscape of global risk, reputational risk, local legal and regulatory risk, and local codes and ethics standards as it pertains to and impacts the activities conducted by the company and review all materials related to distribution channels business promotion activities, including without limitation, sales campaign, marketing pre-approval requests etc.

Provide advice and guidance to the business on compliance matters, including interactions and practices with health care professionals/healthcare organizations, government officials and patient associations.

Conduct ad-hoc/regular compliance updated exercise/review and testing on distribution related matters.

Compiling compliance-related reports both in regular and ad hoc basic when so required.

Actively follow compliance trends in the market and regulatory environment including in business practices and evolving compliance-related legislation.

Perform other ad hoc / related duties as assigned by management to support Legal and Compliance Department.

Job requirements

Bachelor's degree in Law or related disciplines.

Minimum of 10 years' relevant experience in compliance related disciplines, preferably from healthcare industry and with experience in interactions with healthcare professionals or organizations requirements.

Ability to influence others to drive action and unlock problems, without creating disruption.

Ability to absorb partial information from different sources and make sound judgment even with ambiguity

Integrity and honesty, self-initiative, independent, detail oriented with good inter-personal skill and strong analytical mind.

Experience working in and being comfortable with matrix organization and reporting lines, and cross-functional teams without clear single leadership

Able to work under pressure and meet deadlines.

Excellent command of spoken and written English and Chinese (Mandarin is a must).

Proficiency in the use of Microsoft Excel, Word, and PowerPoint.

Candidates with lesser experience will also be considered.
