MARK A. BARBERO
Mark A. Barbero has been in the field of Workers' Compensation for over 20
years. He began working for the Special Funds Conservation Committee in New
York City as a Hearing Representative. Here he was introduced to the
intricacies of Sec. 15-8 claims.
He went onto work for Chubb Insurance (New York City) as a Hearing
Representative and Claims Examiner. After Chubb Insurance, he worked for
Keevily, Spero & Whitelaw as the Director of Claims. It was here that he
was exposed to experience rating modification formulas.
In 1995, Mark A. Barbero started his own Consulting firm. Primarily, he
reviews Employer's experience rating modification factors from a claims
perspective. If he obtains a Refund and/or a Credit for the Employer, he
charges a 30% contingent fee.
REASONS FOR A REVIEW
Based on my experience, insurance companies do not provide this service.
There is no incentive for an insurance company to return premiums to their
policyholders.
TYPES OF ERRORS DETECTED
1. Clerical errors: A Claims Examiner sets up an inflated reserve on a
claim and you as an Employer get over-charged.
2. Second Injury Claims: These involve large claims where the Employee
had a pre-existing condition. Rating Boards generally allow the
current and 6 prior experience modifications to be revised for these
types of claims.
3. Subrogated Claims: These claims occur when someone else was at fault
or partially at fault. The insurance companies recoup monies from a
third party but rarely apply that credit to your account.
4. Fraud Claims: In NY, The Rating Board allows you to revise the current
experience modification factor and 6 prior ones.
